Last week, the Department of Justice (DOJ) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), now under the leadership of newly confirmed Director Robert Cekada, rolled out a lengthy list of final and proposed rule changes to a wide range of federal firearms regulations. They contain some noteworthy developments for Second Amendment advocates.
The Trump administration’s rule changes are a welcome announcement – particularly since there has been a bit of a gap in Second Amendment action since the President’s February 2025 executive order on “Protecting Second Amendment Rights.” As of this week, several of both the final and proposed rules have now been officially published in the Federal Register.
For those who may not be up to speed on these recent actions, the spectrum of issues addressed via this regulatory rollout is wide and diverse. The package includes everything from reducing the paperwork burdens for Federal Firearms License (FFL) holders, to simplifying the background check paperwork (namely the 4473 form) for gun purchasers, to clarifying gun and component definitions, to modernizing how records are kept, to reversing unnecessary bans on certain firearms components – just to name a few significant changes.
Of note, in its initial announcement of the package last week, DOJ indicated that this slate of proposed and final rule changes is “only the first batch of incoming changes that the Administration has planned.” So, we may be in store for more reforms down the line.
Importantly, ATF has provided the public with the rationale, statistics, metrics, and arguments for why it is making these changes. In a stark reversal from the Biden administration’s assault on the Second Amendment, the Trump administration’s reasoning is rooted in the reality of lawful gun ownership, a greater respect for individual liberty, and the facilitation of lawful commerce.
For Americans concerned about preserving and protecting their Constitutional right to keep and bear arms, not only is it worth the time to become familiar with what the administration has put forth in this package, it is also worthwhile to help shape the final form of these regulations via open comment. After all, several of these regulations will have a direct impact on gun owners – such as the rules focused on streamlining, easing, and clarifying processes to purchase or sell firearms. Any American can freely offer their support or thoughts on how to improve the proposed rules.
At the same time, other issues that the Trump administration has addressed drill down to more profound concerns about liberty and government overreach. For example, one of the proposed rules seeks to reduce the time that FFLs must retain 4473 paperwork, which contains personal information on firearms purchasers.
Prior to the disastrous Biden years, FFLs only had to keep the 4473 forms on hand for 20 years. Records older than that could be destroyed, which meant that paperwork linking buyer to gun type wouldn’t run the risk of being eventually collected by the government (all FFLs that go out of business have to turn in all of their transaction records to the ATF). In 2022, the Biden administration took a hard left from past practice and forced FFLs to keep their records indefinitely, almost guaranteeing that all firearms transaction records would eventually get into the hands of the federal government without a rule change.
Now, under the new proposed Trump rule, the period will either be set at the old 20-year mark (which worked fine for decades) or 30 years.
Incidentally, the rules package also proposes placing a sunset on how long the background check records are to be kept by the ATF for firearms tracing purposes. The ATF admits in its proposed rule justification that most issues related to gun crime that require law enforcement tracing requests involve guns purchased within that 20-year timeframe – so there is little reasonable or logical reason to keep records beyond 20 years. For a lot of reasons – not the least of which being concern about our government keeping tabs on what firearms we own – reducing this requirement makes sense.
It is important to note that with official publication, the clock now ticks on the sequence of actions to finalize the proposed rules. This process starts with a time-limited open comment period where the citizenry can review the information and submit formal comments. For these proposed rules, the comment period is 90 days. Once this period closes, the agency will complete its review of everything on hand and make final determinations.
In a statement last week, the ATF indicated that “the agency is committed to reviewing input in a timely manner and ensuring consideration of significant feedback into the final rules.” With luck, once the comments are closed, the agency will move swiftly to finish and promulgate these final regulations.
For the first time since Trump left office in 2021, Second Amendment advocates and law-abiding gun owners have tangible reasons for optimism again. While more work needs to be done, after four years of relentless assault under the Biden administration, the Trump administration is finally correcting those errors.

No gov’t agency should have the power to regulate a constitutional right, and no state should have the power to limit that right. That being said, I hope there will be a clarification that any state’s permit to carry is valid in every state and magazine capacity limits will be lifted.
There will always be evil and that evil will use whatever means to accomplish their carnage. Unfortunately society, (rather government) hasn’t learned that a balance of power is necessary to provide detente. If evil has an advantage, it only serves to continue. Meanwhile, agenda driven democrat politicians and bureaucrats have disarmed only the law-abiding and makes lambs for the slaughter. Gun control argument has only emboldened criminals and has only created more lawlessness. The second amendment is for law-abiding citizens and the only defense against tyrants and thugs.
Criminals tend to never go where a superior deterant awaits them, they are counting on disarmed prey.
I live in a very blue state. The socialist/democrat legislature has done everything in it’s power to limit second amendment rights. We had a permit system to legally carry a fire arm. The legislature didn’t like the law and passed a more difficult system that requires hours of training, on the range testing and of course a higher “fee”. It doesn’t take into consideration anyone that had previously had a permit or the amount of prior training. With multiple years of firearm ownership and training, I no longer have a permit to carry. The socialist/democrats in charge have just “released” many former legal carriers to illegal because of their ridiculous regulations. And, they don’t get to collect the required “fee” as well. So much for informed politicians willing to fight for citizens rights. I hope my state will be required to give it all back with the new federal laws.
I would love to see a universal carry permit that was valid in all states. It sure would make travel much easier.
I’m thinking that instead of twenty years. It should be ten years to keep these records. Ten years is a reasonable amount of time. No need for twenty years like th atf says.
Another thing is, why do banks or any financial institution need to keep track of law-abiding citizens purchase of firearms? There is no need for them to track our purchases. It’s a violation of our 2nd amendment rights and our freedom. Something needs to be done about it.

The antiquated FTA was almost done away with in the Big Beautiful Bill. But Repubs caved to a liberal woman who scrubbed that part of it. Keep gun-hating liberals out of gun laws.

How about bringing back the death penalty, that would be a change, applying the law the way it is written ,not the way many judges interpret it, deal with the criminal the way he should be dealt with, charge the judges who let them free with the crime they’ve committed, would that suit? This article is poorly written. It should have listed the proposed changes. Instead it’s a bunch of rambling on things that might or might not change. What I want to know is how will these changes benefit the gun owner. Not many of us have an FFL. It should be uniform accross the board which firearms I can purchase. It shouldn’t be well, I can only select from a list of firearms on the California web site. That is completely stupid.

It has bordered on lawless since Clinton was president. I say ABOLISH the ATFE! Fold all employees into ICE, FBI, or any other federal law enforcement agency. When bureaucrat COPS are allowed to make up rules that NO ONE KNOWS ABOUT, then there is no ADULT SUPERVISION of that agency. FYI, ATF, we now have things called computers. we also have memory thingys (new gov’t. term) that can STORE RECORDS.

The only gun control measures that I’m accustomed to is a sharp eye and a steady hand. All other laws on the books were null and void prior to the ink drying in accordance with our Constitution and Bill of Rights.

This informative article is a big help to those of us, who have lawfully kept firearms. My life will not be changed. I would just like to see our prosecution get tougher on juvenile gun crimes, knowing that these young criminals do not have a license to own. I would take it a step further, if these heathen kids cannot be charged, then charge the parents.
Remember, as parents, we are supposed to monitor the behavior of our offsprings.

Law should be a non violent felony that did not involve a firearm should be changed to allow an individual to purchase a firearm after say 15 years of no issues. I’ve a friend who can’t protect his home because 56 years ago he stole a bicycle and it was a felony. its ridiculous he is still held as a criminal.
No matter any gun prohibited law ever placed, there hasn’t been any instance where that prohibited in place law actually “prevented” a crime from occuring. That in itself, is justification to stand strong on the 2nd amendment. “The RiGHT of the people to keep and bare arms “SHALE NOT” be infringed”. Simple as that.
“Rights” are said to be endowed by the creator. Any “right” that can be restricted or regulated is not a “right”. The 2nd amendment is a RIGHT as stated in its language. “…the right of the people to keep and bear Arms, shall not be infringed. “
I am hoping that regulation of suppressors is lifted completely. Using logic, which I know is not typical for government, the effects a suppressor has on a firearm include: Makes the firearm longer and less concealable. Requires the use of sub-sonic ammo to reach the best noise reduction, which shortens the effective range closer to the distance the reduced sound will travel, eliminating the argument that you could shoot someone without be heard. Suppressors are just mufflers, like we require on motor vehicles and gas powered lawn equipment, they DO NOT eliminate the sound of a gunshot. They will save the hearing of hunters who need to hear their surrounding, but can not move so much as to put on hearing protection without spooking the game animal, or have the time to do so, before taking a shot.
It still doesn’t help legal gun owners in states where medical marijuana is legal. In my case, I am allergic to painkillers. I used marijuana to sleep.
On the federal background check, I have to check that I use marijuana which is an automatic denial.
I cannot purchase the new gun until the feds decide to allow it in states where it’s legal or to remove it from the federal background check or emphasize that it is a legal medical marijuana user.
So my second amendment right are being infringe upon for something that’s legal in my state. Now I don’t drive when I use, but I do like being out of pain so that I can go to sleep.

All gun laws are unconstitutional. Our rights are granted to us by God not the government. The governments only role is to protect our rights not infringe upon them. However, I do support background checks and there should be an emphasis on mental illness.
The 20-year record retaining portion concerns me in relation to “cold cases” What happens if after 20 years a weapon suspected of being used in a cold case needs to be linked to someone. The records of ownership will no longer be available to investigators.
