Liberals Go to War with the Constitution Over Trump Tariffs

There has been no shortage of unhinged reactions to President Donald Trump’s tariff agenda, but two recent developments in particular are worth mentioning as indicative of a disturbing trend within the American left.

First, in California, Governor Gavin Newsom is proposing something akin to negotiating his free trade deals with foreign powers to bypass Trump’s tariffs. This move appears to flagrantly violate the Constitution and Newsom’s oath to uphold it. Meanwhile, on the other side of the country, at least one liberal lawmaker in Rhode Island is so upset with Trump’s tariffs that he has requested that the governor revert to British colonial trade law from the 17th century to undermine a democratically elected president.

President Trump’s “Liberation Day” tariffs coupled 10% across-the-board fees with additional imposts totaling half of each nation’s trade surplus with the United States. He then suspended the “reciprocal tariffs” on most nations but imposed significantly higher fees on the People’s Republic of China.

In response, California Governor Gavin Newsom filed a lawsuit last week, implausibly asserting that the president lacks the statutory authority to impose global tariffs. In reality, Congress deferred “sweeping powers to the President to control economic transactions” under the International Economic Emergency Powers Act (IEEPA), as the Congressional Research Service has noted.

Presidents have declared dozens of national emergencies since IEEPA’s passage in 1977, and 57% of them remained in effect as of last January. It’s hard to argue with President Trump’s concerns that overreliance on China for strategic goods could undermine national security. 

Undeterred by this apparently obvious legal reality, Newsom earlier this month also instructed his state to “pursue new strategic trade relationships with international partners.” He pleaded with other countries “to exempt California-made products from any retaliatory measures,” because, unlike Trump, Newsom asserts, he believes in “fair, open, and mutually beneficial trade.” Under his watch, we are told, “[T]he Golden State will remain a steady, reliable partner for generations to come, no matter the turbulence coming out of Washington. California is not Washington, D.C.”

Of course, states crafting their own trade or foreign policies violates the Constitution, which vests Congress with the power “[t]o regulate Commerce with foreign Nations” (Article I, Section 8, Clause 3). The Supreme Court has repeatedly ruled that foreign trade agreements remain the exclusive privilege of the federal government.

Back in 1915, in Brolan v. United States, the Court ruled that the federal government’s control over foreign trade is so complete that Congress could “absolutely prohibit foreign importations,” if it wished. In 1933, the Court ruled in Board of Trustees of the University of Illinois v. United States that “the control of importation does not rest with the state but with the Congress,” because “[i]n international relations and with respect to foreign intercourse and trade the people of the United States act through a single government.” In the 1976 case Michelin Tire Corp. v. Wages Tax Commission, the justices unanimously reiterated that states cannot regulate foreign trade, because “the Federal Government must speak with one voice when regulating commercial relations with foreign governments.” That decision was then reaffirmed in 1979.

Perhaps bowing to the limits of American jurisprudence, one Democratic lawmaker has proposed his state ignore the U.S. Constitution – and the Declaration of Independence – entirely and return to a long-dead statute enacted by the British crown.

“I would like to respectfully request that you use the powers of your office as granted by King Charles II in our 1663 Royal Charter to establish free trade zones in the state of Rhode Island,” wrote State Rep. Joseph McNamara (D-19) to Governor Daniel McKee, a Democrat, on April 9. “The Royal Charter states, ‘Upon the lawful and civil occasions and to converse, and hold commerce and trade, with such inhabitants of other colonies peaceably. And lastly, we do for us our heirs and successors grant unto said Governor and their successors.’”

“The Royal Charter expressly gives your office the ability to establish free trade zones in the state of Rhode Island,” McNamara averred.

McNamara’s citation of the 1663 British manifest is both illegal and irrelevant. The Declaration of Independence rendered all royal privileges and prerogatives moot. The U.S. is no longer governed by the Sovereign of England (although we have unhappily become the home to the king’s younger son and daughter-in-law).

McNamara also misinterprets the Royal Charter, which legalized “commerce and trade with such inhabitants of other colonies.” Not even the ugliest American would assert Uyghur slave laborers work in American “colonies.” The charter’s previous clause defined that term as “the rest of our Colonies in New England,” as contrasted with “our kingdom of England.” These 13 “English Colonies” became the United States.

The Constitution not only allows but compels Rhode Island to carry out free trade with all 50 states — which is precisely the economic zone President Trump intends to enlarge. And Americans have good reasons to believe Trump’s proposed deregulation and tax reforms will more than offset any negative consequences of tariffs and spur an economic boom greater than that under his first administration. Democrats’ real problem is political, not economic.

McNamara’s back-to-the-future trade policy reveals the extent to which the Democratic Party has become a post-American party. Denial of American exceptionalism has become a hallmark of Democratic rhetoric.

Then-New York governor and current New York City mayoral candidate Andrew Cuomo won the media’s adulation after insisting President Trump is “not going to make America great again. It was never that great.” Liberals seem to believe all the wealth America has gained since 1619 is illegitimate; therefore, they should furnish our entire GDP to any foreigner who requests it as a form of reparations. Of all the president’s personality traits, his patriotic insistence on prioritizing his own citizens most triggers the liberals’ Trump Derangement Syndrome.

While Democrats continually warn that President Trump harbors racist, dictatorial designs, they retreat behind the laws of dead white men who believed in the divine right of kings. Apparently, some liberals so seek to sabotage the duly elected president of the United States’ America First agenda that they would prefer to invoke centuries-old powers conferred by unelected monarchs. Nothing about that process is democratic.

So I will wait patiently while these democrat(s) states continue to put their collective foot in their collective mouths. Won’t it be interesting to see a governer or Federal representative to be arrested for violating the constitution (and their oath of office)!

Democrats want business as usual and while failing policies of the past are the only thing they have to offer, it’s clear this obsession has nothing to do with what’s best for the country. President Trump has clearly exposed the deals that have ruined this country in our lifetimes. Undoing this damage isn’t an overnight event but as things improve, we’ll see what or who was behind this debacle. Americans are impatient and like spoiled children want everything now, dems are counting on this, don’t fall for their rhetoric.

All of these trade deals with most of the world need to get done ASAP before the latest liberal judge stops Trump’s agenda. I am SO SICK of hearing about California wasting money and time fighting Trump. What the heck is wrong with the voters in that state? And now, Kamala Harris wants to be Governor? The rest of the country needs to literally cut off California from ALL FEDERAL funding, support, you name it. I grew up in Ca and finally left the state in 2009. CA is a beautiful state with so many wonderful people, who clearly are now very much in the minority. The Nancy Pelosi’s, Maxine Waters and Adam Schiff’s have literally RUINED the entire state. No wonder so many people are fleeing.

Sone years back AOC suggested that Republicans be “put in re-education camps”. Think about that.
The democrat party is the party of anti-Constitution, the party of slavery, bridge hangings, burning crosses in the yards of those who opposed slavery, the “Civil” war to keep slaves, the party who favors illegals over citizens, who pervert and twist the law, truth, history. The party who want to change children into something they’re not. The party bleeding from the eyes to disarm we the people. In 1994 a democrat president presided over the slaughter and burning to death of about 80 American citizens, moms and children CS gassed, while the left “media” cheered on the carnage. He was charged with, ready? messing with an intern in the Oval Office. The same president who, with his wife, stripped Air Force One of it’s linens, silver and whatever they could steal. Fortunately they were busted. Oh the president? Wm. Jefferson Clinton; democrat. Add the mysterious deaths, one even making the Wall Street Journal. She was found in the Washington DC’s lion’s cage. A cage that had recently been fortified for more safety. She was partially eaten….and was to testify against the Clinton’s in court. There is a long history of mysterious deaths associated with the Clinton’s including Waco.
It was, I believe, a democrat vice president who was behind the assassination of President John F. Kennedy…he was one democrat I do believe, loved this nation. This vice president, Lyndon Baynes Johnson who took his place, again I believe, also was one of the major players to start sending our manufacturing off shore, maybe involved with Kennedy’s death?…then think Detroit once the shining jewel of manufacturing. Oh, lest I forget, add a deliberately weakened criminal justice system that puts hardened murderers in prison with laughable sentences so they can get out early if they “behave” and continue their life of crime. New Mexico our neighbor to the south, is number 1 in the nation for violent crime. Last in the nation for schools, New Mexico…democrat governor.
When I look at the history of the democrat party I can’t help but wonder why they’re even allowed to exist in this Constitutional Republic.

This is not unexpected. These people will resort to anything to stop not only Trump, but this nation. As for Newsom, you know he is in the pocket of the Chinese. He did, after all , their leader in California. Even cleaned up the tent cities so as to not offend him. As for Cuomo, why the hell would he run for another term in a country he feels “was not that great to begin with”? That is why he ruined New York, Go live some place else, please. Preferably China. And when he does, I hope he tries to buy a car there!!! He’ll only be able to purchase what they let him buy, as well as anything else. I’d like to see him have to give whatever money he has to the government, instead of stealing it from the taxpayers here!

Please let Nancy Piglucy’s in-law negotiate a trade treat5y with a foreign government. Then he can be removed from office and jailed. Only the President i=of the Untied States can negotiate treaties.

If these liberal states want to set their own trade, and other policies, they should first secede from the Union and form their own country. They would quickly realize the advantages of being part of the United States (or maybe not, their leaders don’t seem that smart).

Then why hasn’t Newsome been arrested? If he is breaking the law arrest him. It’s always the same with the Republicans. They have lots to say but no one ever gets punished or is held accountable.

The most important part of the article is where it says the Constitution “vests Congress with the power “[t]o regulate Commerce with foreign Nations” (Article I, Section 8, Clause 3).” Seems like Congress is missing in action. I get the China stuff. But is putting tariffs on Australia, a country that buys more from us than we buy from them, part of this national emergency?

We put up with all the unbelievable garbage Biden put our country through and waited to legally get elected into power (something I don’t believe Joe did) but these crybabies won’t repay the courtesy. They do whatever they want no matter what the Law says. Are they so stupid as not to realize that if they successfully dismantle the Law in this land they will also discard it’s protections for them as well? If there is no Law the vigilantes will be free to go after them. Sometimes I think the Left has a real death wish!

The demoncraps are so stupid it’s beyond words. If little gavin newsom has directed his employees to “pursue new strategic trade relationships with international partners,” and they do it, then he and they will all be guilty of subversive behavior. Specific examples of subversive activities are outlined in Title 18 of the U.S. Code, particularly in Chapter 115, which covers treason, sedition, and subversive activities. Charge them all and throw them in jail where they belong. I’m sick of this garbage, and these people need to be treated as the criminals they are. They are waging war against the US Citizens and our duly elected POTUS and other officials. Hold them accountable for the BS and wrongdoings. Enough is enough!!!

There is nothing that President Trump does they will like just like the corrupt judges these governors are no different they want things done there way and they will never side with President Trump they did side with corrupt Biden and Harris on everything so now we have nothing but high inflation but of course Democrat people in Washington and these governors could care less about the people here obvious people in California feel the same they could care less same goes in every Dem run state.

In my opinion, Congress should be in charge of taxes & not the POTUS. And tariffs are a tax & Trump said that we are getting $2-3 Billion per day from these. But, the US consumers will end up paying for the tariffs & that will keep inflation rolling up.

The trade war has a hidden danger to all Americans. The US does not have some raw materials & minerals ad must import from other countries. Tariffs on all of these countries will make new enemies & they could stop trading with USA and make deals with each other. Worse yet, if they stop selling us critical materials that we need . Trump should have stayed small on tariffs like he did during his first term. And he has lost his reputation for deals if he does not back the agreement he signed with Canada & Mexico during last term.

I am a Trump supporter but have to take issue with the ongoing tariff madness. They are huge tax increases of another name “gifted” to the American people at a time when the nation is in financial dire straits due to the actions of the previous administration. Prices for just about everything will go up and go up rapidly and to high levels.
But we bought the BS so here we are. Lets forget our poverty for a moment and go full bore support of baby killing for our Israeli masters.
