Democrats’ Court-Packing Redux

In a now predictable pattern, Democrats are once again calling to pack the Supreme Court with liberal partisans following a few rulings that didn’t go their way. While most of the corporate media has treated this shocking attack on judicial independence with barely a shrug, Americans should view Democrats’ rhetoric as an existential threat to constitutional order.

During a call with a left-wing nonprofit last week, former Vice President Kamala Harris – who is also the frontrunner for the Democrat nomination in 2028 – outlined a string of astonishingly radical policies that she said should be on the table, including adding Washington D.C. and Puerto Rico as states and abolishing the Electoral College. But the idea that seems to be getting the most traction on the left is expanding the Supreme Court to add more liberal justices.

“Let’s invite ideas, for example, that are about Supreme Court reform, including the notion of expanding the court,” Harris said.

Democrats have a long history of court packing stretching all the way back to President Franklin Roosevelt. Frustrated by the Supreme Court striking down his radical and unconstitutional expansions of federal power, Roosevelt pushed for a bill in 1937 which would have allowed him to appoint six new justices, expanding the Court to 15 seats. The idea drew intense opposition in Congress, even from many Democrats, and ultimately went nowhere.

More recently, court-packing became a major issue in the 2020 Democrat presidential primary. Upset at President Donald Trump’s appointment of three originalist judges, at least five major candidates – Sens. Elizabeth Warren, Kirsten Gillibrand, and Kamala Harris, as well as former Rep. Beto O’Rourke and South Bend Mayor Pete Buttigieg – supported court expansion. Still, the idea never seemed to make it very far from the fringes of the party.

Now, things have changed. The radical elements of the party are now firmly in control, and it appears that court-packing has become a mainstream position for Democrats as they lob increasingly hostile attacks against the Court.

Liberals are particularly incensed following two recent rulings from the Court banning racial gerrymandering and declining to hear a challenge to a Virginia Supreme Court decision which invalidated a new map that would have handed Democrats four more U.S. House seats.

Democrats’ response to these rulings and others that they don’t like is telling. Instead of arguing that their positions were correct on the merits and the law, they are drawing up plans to blow up the system entirely and simply install new activist judges who will rule however Democrats want, regardless of the Constitution or the law.

House Minority Leader Hakeem Jeffries has promised that if Democrats retake power this November, “we’re going to have to do something about the Supreme Court. Everything is on the table.” Graham Platner, the Democrat challenger to incumbent Republican Senator Susan Collins in Maine – a seat which could well decide the Senate majority – has openly stated that he wants to pack the Court and impeach “at least two” sitting justices. “Squad” member Rashida Tlaib (D-MI) has also called to “expand the Court.”

That drumbeat has been amplified by a corporate media machine which has dishonestly portrayed the Court as a corrupt tool of the conservative establishment. “It’s now clearer than ever that Democrats must pack the Supreme Court,” Michael Cohen recently wrote for MSNOW.

What liberal outrage conveniently leaves out is that the Court – including its six nominally “conservative” justices – often rules against the Trump administration and conservative interests. In 2025 alone, the Court ruled against Trump four times, and in his favor 20 times. Most of the cases where the Court sided with the President dealt with frivolous lawsuits by left-wing activist groups attempting to block legitimate executive actions.

Moreover, according to a study from Penn State University, data compiled over the last 40 years shows that Republican-appointed justices are far more likely to break with conservative positions than are Democrat-appointed justices likely to break with the liberal position.

For Democrats, that’s not good enough. Their new position is that it’s all or nothing – either the Court rules in their favor 100 percent of the time, or they’ll add new justices who will.

To their credit, some media voices still understand that court-packing is dangerous, undemocratic, and unpopular. “The reality is that this debate is not really about legal principle, but about power,” Dace Potas wrote in a recent opinion column for USA Today. “Those pushing court packing are frustrated that their preferred legal arguments are failing, and so they seek to accomplish politically what they cannot achieve judicially.”

A Democrat-led effort to add more partisan liberal justices would be a “crossing the Rubicon” moment for the republic. The U.S. Constitution is the oldest active constitution in the world in part because those in positions of authority have respected the separation of powers. Even in 1937, President Roosevelt – objectively one of the most authoritarian-minded presidents in American history – ultimately backed down from his scheme to turn the Court into a nakedly partisan institution.

The Supreme Court is already suffering from a collapse in public confidence thanks to incessant attacks from Democrats and the media. About half of Americans currently hold an unfavorable view of the Supreme Court, up from just 17 percent in 1987 and 33 percent as recently as 2022, according to Pew.

For Democrats, the Court and by extension the Constitution itself are obstacles to their partisan ambitions. It is hardly any surprise that they are now seeking to destroy both.

I REALLY do not understand how people can keep voting for these people. The hypocrisy of the liberals is just mind-blowing. I’m happy to see some RINO’s going away, but I am still quite worried about the November midterm elections. We are going to LOSE OUR COUNTRY if people do NOT wake the hell up!

The Iran war and inflation certainly aren’t helping matters. Sadly, the only campaign promise of the liberal loonies is to “get Trump.” Dummybrats have already dominated the judicial system with liberal activist judges, so get ready for a packed SCOTUS and the statehood of DC and Puerto Rico. Once these are in place, our constitutional republic will become an insane banana republic. EACH FUTURE ELECTION WILL ALWAYS BE CRITICAL TO PRESERVING OUR NATION!!!!! GET OUT AND VOTE!!!

I wonder what is happening behind the scenes after ballots are cast…wasn’t that the problem in Georgia a few years ago? The “deep state” is so well-entrenched in our nation, that most of “we the people” are not aware of it. We need to get rid of the “deep state” and all it’s players, AND foreign “directors” and take our country back. We need to go back to what our forefathers did: “Appeal To Heaven!”

It’s beyond partisan positions. It’s about absolute power by the democrats. Every policy every bill everything President Trump has proposed is taken to court. The Supreme Court has so many frivolous cases that when they make a decision like this racial gerrymandering they scream we need to pack the court. Will 15 be enough? Or when they rule against them do they want to add more. They dismiss the constitution in all of this. They want to rule with an iron fist. The only thing is whatever plan they come up with doesn’t work because they react in the moment. They don’t see the effect some of their proposals or policies will have in the future. They put no oversight in their proposals. No consequences no responsibilities. Just spend and spend and when they run out of money they tax the people by calling it a tax on the rich. Only the rich have left their state or city. The democrats have weaponized the courts and they still are trying to destroy the Supreme Court. Because they follow the law. Not the democrats policies. Which justice Brown is doing. She owes these communists. At any other time she would never have been confirmed to serve. If the democrats ever get a majority in the Congress we will be destroyed. Our constitution abandoned. Our economy crashed and communist rulers in charge.

It makes no difference to Democrats what an issue might be. Did they lose an election, face defeat in the lower federal court system or be set back on their policies. Their reaction has always been if we lose it is not our fault, but we must do something about it. Their answer is blow it up, burn it down and we will rebuild it to our philosophy of government which we now witnessing and that is anti-freedom, complete control over all three branches of the government and permanent power, replacing our capitalist economy with a Marxist economy as we are seeing in New York City, Virginia and Washington State. This is a tipping point for America. Will we preserve our constitutional Republic or let it slip away as Benjamin Franklin indirectly said could happen if we are not vigilant.

Arguing on the merits, I love the way Shane Harris explains this fact about the democrat politician’s lack. He really gives people like me a better understanding of exactly the mindset of their intentions. Many may not be aware of the dangers of “packing the Courts”, and adding extra states. The problem, seems we may not know the results of this until they, the dims, get control. Vote people, and give thought to what you actually “know”, not what ya believe.

You’d think, at least one of them would begin to question WHY rulings are going against them. Lunacy is defined as doing things the same way and expecting different results.
They will also lose the midterm elections. The Republicans already are going to have an

People who are third generation welfare do not give a fig about who is or is not in the office. They are housed and fed, their children are fed, that is all that matters, They have their phones, big screen TV, kids have their computers and all is well in the land of welfare. Only if their existence is threatened will they stir themselves into action to cast a vote for those who feed them I can hear “democrats” howling should there be a proposal you don’t work’ you don’t vote. Citizens only.

All one need do is look at K. Brown Jackson on the SCOTUS bench to get a glimpse of what America would become if the dems were successful at their unconstitutional scheme to pack the court. Indeed it would cross a rubicon and our republic would begin to circle the drain, just as it did under Joe Biden. The harms done to America by a demented, corrupted and easily manipulated old moron like Joe will haunt our republic for years and years to come. We need to abolish this party of insidious evil, and run the reprobates out of DC once and for all, before they succeed at turning our country into an authoritarian dictatorship. That is their goal, power in perpetuity, and our US Constitution eliminated.

With the Dems platform of Pack the Court, abolish the Electoral College, make DC and Puerto Rico states, there should be no way they can win in the Mid terms or in 2028.

However if independents, moderate Demeocrats, and republicans do not get out and vote our Country will be lost.

The Democrats abandoned the US Constitution with FDR’s New Deal. They have their Progressive agenda, and will achieve it by any means necessary — they have no ethical commitment to either the Bible or the US Constitution, and believe the “ends justify the means.” Their desired “ends” are control of the country by a globalist, wealthy, atheist elite that seeks to reduce the US citizen population through the LGBT+ agenda, abortion on demand, and euthanasia under the guise of government-provided “education” and “health care.” They also want to push rapid implementation of AI and automation to replace human labor, replace small business and independent agriculture, and except for a small “middle income” technical/managerial/bureaucratic class, have most of the population dependent upon government “aid,” and thus easily controlled or easily marginalized.

It really saddens me that people lump together everyone who lives in a blue state, as stupid, lazy, ignorant, and the recrimination and condemnations keep coming. Many of us in the blue state see the fraud and wonder why it is not being uncovered and exposed. We had a majority of votes down state for a conservative, but the way the districts are divided Chicago gets more vote then down state. If we leave we leave this state in bad hands, if we stay we can fight and it is an uphill battle. So how about some prayers for corruption to be exposed and those guilty convicted instead of just lumping us all together as a bunch of idiots.

It’s astonishing how ready the left is to dismantle the institutions that have safeguarded our freedom since the inception of our nation. The only way to understand it is to accept that they are nihilists who want to destroy everything and remake society to fit their totalitarian ambitions.
