AMAC Exclusive – By Seamus Brennan
From students and faculty shouting down federal judges on law school campuses, to politically motivated prosecutors engaging in bogus persecutions of former presidents, to the continued politicization of the American Bar Association, the integrity and credibility of the legal profession in the United States has taken a severe battering in recent months.
In early March, the American people witnessed yet another humiliating display of campus leftism and ideological censorship when Judge Kyle Duncan of the U.S. Court of Appeals for the Fifth Circuit was vulgarly shouted down by a mob of students at Stanford Law School who refused to let him proceed with his prepared remarks. To make matters worse, the Law School’s associate dean, rather than restoring order at the event and disciplining the agitators, joined in the circus, confronting Judge Duncan with prepared remarks of her own. “For many people here,” the dean lectured to the judge, “your work has caused harm.”
One of the most alarming aspects of the incident is that it occurred at Stanford – the nation’s second-highest ranked law school – from which many students have gone on to positions of prominence as legislators and judges.
The debacle at Stanford is far from an isolated incident. Although the American legal profession for a time resisted the tides of social, cultural, and political activism—even as the progressive movement co-opted other longstanding American institutions—it now appears that our nation’s legal system is the latest domino to fall to the left-wing activist class.
Nothing reflects the decline of the legal profession quite like the corruption of the American Bar Association (ABA).
Despite purporting to be a nonpartisan entity, the ABA has for years publicly taken leftist positions on hot-button political issues like abortion, same-sex “marriage,” affirmative action, and Second Amendment rights. It has also released blatantly ideological assessments of judicial nominees in a transparent attempt to undercut the legitimacy of conservative judges.
Even going as far back as 2006, a Wall Street Journal editorial lamented the ABA’s “long history” of “ideological sandbagging.” A 2012 study in Political Research Quarterly similarly found “strong evidence of systematic bias in favor of Democratic nominees” in the ABA’s work in the judicial selection process. According to Northwestern University law professor John McGinnis, the ABA continues to levy power by tightening the left’s grip on our legal system “chiefly through its influence in accrediting law schools.”
But the politicization of the American legal system does not stop there. The ABA’s hard shift to the left has also bled into state and local bar associations—resulting in a series of manifestly partisan decisions that further chip away at the legitimacy of our legal system.
In late 2021, Paul Sperry reported in Real Clear Investigations that Kevin Clinesmith—a former FBI lawyer who in 2020 pled guilty to defrauding the court by falsifying a surveillance document in the Russiagate investigation—was restored by the District of Columbia Bar Association as an “active member” in “good standing,” even though he had “yet to finish serving out his probation as a convicted felon.” The panel that reinstated Clinesmith, overseen by Disciplinary Counsel Hamilton Fox, is “a former Watergate prosecutor” and “a major donor to Democrats, including former President Obama,” Sperry found.
“The D.C. Bar’s treatment of Clinesmith, a registered Democrat who sent anti-Trump rants to FBI colleagues after the Republican was elected,” writes Sperry, “has raised questions from the start.”
Of course, lawyers regularly lose their legal licenses for significantly less than the crimes committed by Clinesmith. In fact, the same D.C. Bar panel that reinstated Clinesmith, even in spite of the fact that he pled guilty to a federal crime, suspended the law license of former New York City mayor and Trump attorney Rudy Giuliani—who has been neither charged with nor convicted of a crime.
How can Americans possibly maintain trust in our justice system when our nation’s most prominent legal entities are persecuting their political opponents while simultaneously protecting people convicted of federal crimes?
Regrettably, the politicization of bar associations is only the tip of the iceberg when it comes to the decline of the American legal profession. Troves of left-wing general counsels and legal staff at federal departments have also gone rogue, running roughshod over the law in favor of furthering their partisan goals. Federal prosecutors and district attorneys in cities run by Democrats routinely turn a blind eye to violent crime happening right under their nose—jeopardizing public safety and endangering the lives of American citizens.
In the most obvious example of soft-on-crime, politically-motivated prosecution, Alvin Bragg—the Manhattan district attorney who indicted Donald Trump on spurious-at-best legal charges in an act of barefaced political retribution—willingly allows violent and hardened criminals to roam free.
And of course, leftists working in the field of constitutional law have now entirely surrendered to the interpretive methodology of “living constitutionalism,” which purports that the U.S. Constitution and existing legal statutes should be cast aside in favor of whatever legal outcome is most amenable to progressive activists.
From the moment of our country’s inception—and from the very onset of Western civilization—the rule of law has stood as the hallmark of a free, functioning, and flourishing society. As such, the ideological infection of the U.S. legal profession poses a severe threat not only to the stability of the American justice system, but also to the principles enshrined in our nation’s founding and the future of Western civilization itself.
even Lawyers hate you and want you in jail lol
Here are some interesting facts, there are over 1,350,000 lawyers in the USA, the highest per capita in the world. There are 800,000 law enforcement officers (137,000 are feds) in the USA, meaning there are 1.7 lawyers per cop. I worked with lawyers for over 40 years and some of my best friend are lawyers but it has been my experience that they can take something very simple and make it very complicated, thus creating a need for more lawyers.
so, now it 99% of the profession giving the rest a bad name?
This is the result of the degradation of our education system over the last hudred years or so. Among other things they have produced the legal parasites of our country, and turned the medical profession into the woke practice we now have.
How long do you think the American people will tolerate this situation? Americans are traditionally not easily swayed by demigod wannabes who wish to impose their thinking on the rest of us. We are independent thinkers who recognize a problem when it occurs. The Constitution is the law and not leftist student sponges who seem to soak up everything their leftist professors are selling. If it continues, I believe there will be a movement soon that will demand change.
Hell all DC is a cesspool of lawyers via ABA & we all suffer with damn 2 tier Justice system
Purge ABA & Law schools alone
A race to the bottom between two professions …
On the “Left” – Legal.
On the far “Left” – Journalism.
Disgraceful performances by both.
What is happening in ALL colleges, regardless of the subject, can be contributed to the leftist views of the professors. This is even beginning to occur in high school. We must stop this leftist education that our children are receiving. This is the same as is happening in government.
Anything for money and corruption by politics. The legal system has gotten too soft on psychotic criminals in pursuit of winning at any cost or lie or trick. It has become a bad example of human nature. Pathetic.
The plan is working. The MSM is under their control now that Fox has gone woke. The judicial system is under their control. We law abiding citizens do not have a chance to be protected by these lawyers and judges. You have to be a leftist or a dem.
Destruction by division of America is complete.
Liberals are okay with free speech until you disagree with them or have a different point of view.
Until people start teaching their kids the value of integrity and truth, above the almighty dollar, the bottom line will continue to rule this nation. Grift, and people like Soros, count on a corrupt education which offers up many people willing to sell their souls at any price and hurt anyone that disapproves of that corruption. We need to end “tenure” as teachers cannot be fired even when they go against what should legally be taught in institutions of learning. Too much Marxist/Fascist indoctrination of our kids by corrupt people in teaching positions. Some even have backgrounds that should have prohibited them from ever entering a classroom in the first place!
I envision our SCOTUS being very busy! May our conservative justices live long and fruitful lives.
To protect ourConstitutional Republic and western civilization eternal vigilance is absolutely necessary. American taxpayers have been very lax in not demanding excellent, Constitutional policies from every elected official. Proof of that is the human garbage now living in OUR WHITE HOUSE and what he and his cronies have done to our country. Congress could have stopped all of this unAmerican activity but didn’t.
What’s 50,000 lawyers on the bottom of the ocean?
A good start.
Lawyers are a bunch of Democrats who get rich off of other peoples ills! We have two things we call them, Ambulance chasers and as bad as used car salesmen! Today they are worse: liars and Democrats!
That’s not all that is declining in AMERICA,how about everything that the democRATS have touched, including common sense.
Thank Goerge Soros & Co.
The infiltration of the left into absolutely everything is complete and has been for some time, when a segment of society finds themselves already flushed down the drain, coming back is very nearly impossible.
The demonrats are going to turn our country into another China!!! The writing is on the walls!!!
As far as i’m concerned , the Bar Assodiations in America are nothing more than self interested trade groups , just like unions . But , they have too much power over lawyers . And i believe they use that power to keep members in line , to tow the party line , so to speak . Not for our benefit , but to maintain an image of lawyers as beyong reproach . We should not allow bar associations to be able to ‘dis-bar’ any attorney . Licensing of lawyers should be governed by States. When you consider that some attorneys , Like Adam Schiff , are lyers , you realize then that the Bar associations don’t actually do a good job of policing bad lawyering . So, why should lawyers be allowed to police themselves ?
To compromise on legal presidents that have established right from wrong years before is no different than the broken window policy . Once it starts to slide ,get out of the way or stop it !
Just look at Bible principals and see how far they have fallen .
Man may never correct there problems but The Great God of creation will !
The slide down for the law profession started when ‘Blackstone’ was thrown out as the basic law book. It contained morality, true justice, ethical guidelines, and a lot more. Dig into the story of a young lawyer named Charles Grandison Finney and see the impact it had on him.
When a lawyer or a politician is sworn into the practice of law [or their political office] they take an oath to support and protect the Constitution of the United States . It has become very obvious that these “persons” had no intention of standing by their oaths. The country is slipping downwards because so many of our lawyers and politicians have no integrity and blatantly disregard the values they swore to protect.
The ABA has outlived its usefulness. Sadly, it is entrenched in the woke world. During President Trump’s second run for President, I saw the bias of the ABA firsthand. They ran an article about a law student who wore his “MAGA” hat to law school classes. One professor berated him ordering him to remove the cap (it would probably be ok had it been pro-abortion, pro-gay marriage, or pro-transgender).
The ABA writer attacked the student’s position as though he was a serial killer. I wrote a letter supporting the student’s right to express his opinion, especially if other students were allowed to wear “WOKE” messages to the class. My opinion letter did not fit the ABA’s mantra of tolerance, free speech, and left-wing perfection.
I canceled my subscription and accepted the fact of one more institution lost to the lawless hoardes.
Nothing on the corrupt Clarence Thomas?
I am an attorney who once was a member of the ABA. I did not renew my membership after I found it promoted ideas I did not believe. There are many good attorneys who are ethical. The ones in power, such as in control of the ABA, are not neutral but are only focused on what they want, not the good of the States or the United States.
The election of Obama was the beginning of the end for our country as we know and love it That was his goal after all: “fundamental change.” The Deep State and corruption have overcome our Constitution and principled people running our government thanks to very ignorant and self-centered voters.
Our US Constitution is a biding CONTRACT, and those elected PROMISE under OATH to PROTECT our constitutional freedoms.
If they lied under OATH and instead tried to undermine or abuse their authority, that is a felony and some people are sent to prison.
Why should Politicians get a free pass, when they are the ones making the laws?
“…and the future of Western civilization itself.”
Whenever you hear a leftist use the term(s) “sytemic racism” or “white supremacy” or similar, insert in its place “western civilization” and you will clearly understand who they are and what they are really about. It has nothing to do with racism, justice (even social), “fairness”, equal outcomes let alone opportunity, diversity and inclusivity; all of that stuff is a smokescreen to turn you into a useful idiot and get you to agree to the destruction of Western Civilization and replace it with one world communism. In effect, it is old fashioned communist doctrine reinvented for a modern audience. Also understand that the “Green New Deal” is a part of this.
Great article , very important information provided Seamus, especially in the last paragraph. You summed up the significant issues very well and what you wrote should be kept in mind by everyone who cares about the United States of America. Those of us who care about the principles concerning Faith, Family and Freedom can look to this article as a beacon of hope as you made it clear, what it is that needs to be fixed. Identifying what needs repair is the first step taken to make the proper repairs , to fix what needs to be fixed. Could be if replacement parts are in short supply, resourcefulness may be needed to make new parts. That could start with the law schools. It could start anywhere , it should be considered as important as the preparation for a severe storm , such as a hurricane, and in some cases as important as the work needed after such a storm . In the spirit of Honor, Honesty, Integrity, Courage, Loyalty , and with respect for the will of God. Let’s defend liberty , and good sense and good character . Well Done ! Seamus, Well Done !
Amazing that people who profess to be so “open-minded” are closed to anyone with a thought different to their own. Listening to both sides of an argument is no longer acceptable by liberals.
I retired in 2007 from practicing law after 44 years. Based on this article, I am glad to be out of the profession. I never realized that my fellow lawyers were so closed-minded.
Gotham is alive and running
I’m amazed that SCOTUS actually has a conservative majority, and hope Clarence Thomas can hold on to his seat. As for our future, I’m reminded of a quote from Victor Davis Hanson that says it’s not preordained that America will prevail as an independent nation. I hope I’m not around to see the final outcome.
Woke is the new Nazism with Antifas serving as their stormtroopers.
It’s fallen, e.g. become compromised and corrupt because Soros has been allowed to choose and pay off the judges. Soros needs to be banned from the U.S. I have been saying this for many years. Maybe some day it will happen,
Very sad but honest and well-written.
Maybe if more people pushed for election reform where IF you can NOT vote for the candidate, then you can NOT give that candidate money would become an enforced law, then maybe things would change.
Criminal lawyer, is redundant.
I would put the blame on both Democrats & Republicans, as they both think that judges & justices that they approve during their terms should lean either liberal or conservative. The 3rd branch of govt. is the Legislative branch & justices on SCOTUS should be non-partisan. But it seems like the party that is President freely comments when SCOTUS makes rulings that they feel is not in line with party lines.
The fundamental problem, like our public universities, leftist radicals have captured the law schools. They decide who gets in (based on the usual intersectional criteria, which doesn’t include merit), what is taught, and with what bias. There’s a heavy emphasis on activism, social justice (whatever that actually means), “equity,” and “public service.” You’ll notice that the last couple of Biden judicial candidates couldn’t answer basic, high school level, constitutional questions in Senate hearings. It was epically embarrassing and disturbing. But these lawyers/judges don’t care about the constitution. To them, our constitution is an obstacle to realizing their Marxian utopia. And criminals have more rights than you. People with mental illness have more rights than you. Our legal system is teetering and the founder’s concept of a free individual with inalienable rights is under threat.
“leftists working in the field of constitutional law have now entirely surrendered to the interpretive methodology of “living constitutionalism, which purports that the U.S. Constitution and existing legal statutes should be cast aside in favor of whatever legal outcome is most amenable to progressive activists.” They are just following Lincoln, who cast aside the Constitution to achieve his progressive activism.
