Ohio – which has a Republican governor and Republican supermajorities in both chambers of the legislature – has become the latest state to consider legislation allowing utility companies to seize control of thermostats during heat waves or shut off hot water during peak demand in the name of protecting the power grid. Other states are considering similar measures that critics say represent an egregious violation of private property rights and shift blame to customers for the failure of politicians and utility companies to improve grid capacity and reliability.
The legislation under consideration in the Buckeye State is being sold as an effort to “modernize Ohio’s energy regulations and help homeowners and small businesses save money while improving electric grid reliability.” The bill would create “voluntary demand response programs, where participating customers can allow utilities to temporarily adjust energy usage, such as raising thermostat settings or cycling water heaters, during periods of high demand.”
Rep. Klopfenstein claims customers could “override these actions” and that other states have implemented similar programs with success.
“Demand response programs have proven to be a vital tool for our large commercial users, and it’s important that similar programs are made available to residential and small commercial users,” the Republican claimed. “These programs will ease the strain on our energy grid and save money for all Ohioans.”
But the experience of other states shows that these promises are paper thin, and there’s no guarantee customers will always be able to “override” the controls.
Colorado serves as a cautionary tale. There, Xcel Energy operates a voluntary program that also promised tens of thousands of residents they could override the controls if they chose.
But during an “energy emergency” caused by equipment failure in 2022, ABC News’s Denver affiliate reported that Coloradans “learned they had no control over the temperatures in their own homes” even as a heat wave washed over the state.
“I mean, it was 90 out, and it was right during the peak period,” Tony Talarico told the outlet. “It was hot.” Talarico said that “normally” he is able to override the thermostat lock, but “[i]n this case, we weren’t. So, our thermostat was locked in at 78 or 79.”
Asked for comment, the utility company shockingly blamed the customers and emphasized that they signed up for the program (leaving out that they were promised they could bypass the controls).
“It’s a voluntary program,” an Xcel spokesman told the news outlet. “Let’s remember that this is something that customers choose to be a part of based on the incentives.”
But as Colorado Public Radio noted, the utility program changed the rules in the middle of the game. While the program says it can be used during “the hottest summer days,” it said nothing about “thermostat adjustments due to equipment failures.”
Other states have proposed going much further, taking away any agency for consumers and forcing them into the program. A bill in Connecticut, for instance, backed by both Democrats and Republicans, would give utility companies the same ability to take over not just thermostats and water heaters, but also electric cars, inverting the batteries to put power back into the grid.
Some people fear that this is part of a larger plan to restrict energy usage and make government even more invasive in the lives of everyday Americans. “This legislation is a slippery slope toward centralized, government control of private energy use,” Chris Herb, CEO and president of Connecticut Energy Marketers Association, said in April. “It erodes personal choice, home comfort, and the basic right to control appliances and vehicles you paid for with your own money. When does it end?”
Others have pointed out that the companies are charging customers more for not having smart meters, which could coerce Social Security recipients and other low-income individuals into signing up to save money. The program may appear to give customers free will, but imposed costs for not complying will effectively force many to submit to allowing utility companies to control their air conditioner and other appliances.
“Participation in programs like AC Rewards [in Minnesota] will be voluntary at first, but like the $180 fee, I predict the extra costs associated with not allowing the utility to control your power will eventually become cost-prohibitive, especially for low-income families and businesses,” Isaac Orr, an energy researcher with the Center of the American Experiment, warned in 2024.
These “voluntary” programs all start the same way: they come into houses under the guise of installing helpful “smart meters” with the supposedly altruistic goal of helping Americans save a few dollars on electricity. Oftentimes the companies even offer $100 or more as a “gift” for compliance.
However, when the grid gets overwhelmed, for any reason, the companies can take control and shut down air, heat, and hot water. Instead of focusing on fixing the problems underlying the grid failures – like overreliance on wind and solar, the decommissioning of fossil fuels plants, and decades of deferred maintenance – the companies simply turn the blame and burden back onto the customer.
Americans should be wary of such programs as they continue to gain popularity among utility company executives, bureaucrats, and politicians nationwide. While they promise lower power bills, that may come at the cost of personal freedom and comfort.
Ultimately, public utility companies exist to serve the public and cater to their convenience – not the other way around.

Of course you are already tracked and monitored with your Smart Phones, credit / debit card usage, etc. Controlling your thermostat is just one example of what “They” can do within their master plan.
Another example of people control that could lead to government control of the people in the future. The Left continues usurp its control over the people from behind the scenes. Solar and wind power has already been proven that it can’t keep up with demands. With all the rules and regulations that have been passed by the Blue states, infrastructure is not being able to be maintained. Until utility companies get off their behinds and fix the infrastructure. the Left will continue with their agenda behind the scenes.

Our Power company in NC has increased our rates to support the DEI and Green Energy Agendas, neither of which we voted for in this state. I’d like the Federal Government to clamp down on Utility companies like Duke Energy that are pulling this kind of crap!
Letting the utility companies control your thermostat is simply another way the radical liberals creep into our lives. Anyone who values their privacy and sanity would not allow this kind of control to happen. This is akin to the auto insurance industry wanting to put a tracker in your car to prove you are a safe driver…and they will give you a lower premium price. I say NO to these types of “monitoring”.

Here in California, new home developments no longer offer natural gas or wood burning fireplaces. Electric everything without consequences is pure fantasy, then penalizing people who can’t or won’t reduce their energy consumption during peak demands. There is no electric infrastructure, it literally in the dark ages. No new power plants have/can be built because of government red tape at every level. Roving blackouts is now the new smart switch.
No matter. Us ol’ BOOMERS are on the way out, being supplanted by younger folks with phones welded to their hands, and those phones are telling them what to do/think/say and how to act/react/proact and enjoy someone else making their decisions for them. Yup. Funny how the older generations always shake their own collective heads at the BS the younger generations accept, or do. Well, someday these younger folks will be in OUR shoes, and the country will be doing what China tells them to do.

If the power companies had any brains at all they would already know that people CANNOT AFFORD to turn the heat up or the air-conditioner thermostat down!!! Maybe offices, hospitals, restaurants and other corporations are abusing the power….or maybe the POWER COMPANY OFFICES AND THE GOVERNMENT OFFICES are responsible for the high usages. The average young homeowners are out of the house working to support their families and the average retired person is either sweating or freezing in their own homes because they cannot afford to pay outrageously high electric bills. Power companies rip off the average homeowners when they come up with all kinds of schemes to cut costs, then pre-charge the individual homes money for these schemes. Years down the line when they cannot build what we have paid for or they built these schemes and they do not work, the utility company pays you back less than 1% of what you paid out all the years before. It’s a racket that is allowed to continue. Maybe the Republican representatives should investigate where the money and the profit from these power companies is going! I’m very sure it isn’t into repairing grids or working together with other counties to make their systems better. Even on a fixed monthly budget plan you will STILL owe more money because the price of electricity per unit continues to go UP AND UP AND UP.

Beware of Carriage accounts too. These small companies that downgrade companies like Peoples Gas, or Commonwealth Edison ( Illinois) and state if you purchase energy from them your utility bill will be cheaper. I worked for Peoples for 35 years and I’ve talked to customers and energy is not cheaper if you decide to go this route. Beware and stick with your state or county utility.

the main issue in these comments seems to be the issue of gov. control. – take away of our freedom. I think that the left has used their deep state gov. departments to eat away our freedom. Most of the taking away was done in the name (excuse) of safety. PUTTING COMPUTERS IN CARS ACTUALLY DECREASES SAFETY. AND: It has eaten away at our bank acct.s with much higher prices for the cars when buying; much much higher costs for repairs and maintenance. Higher cost of insurance. New cars entertain people who don’t need dependability, as long as they have an abundance of gadgets. We replace home computers every 2 or 3 years because the “software is no longer supported” or “no updates available”. Car computers cost a lot more. The epa has stolen some freedom also. The gov. keeps records from Smog Tests. (how many miles driven etc.) Little bits of our freedom are taken away. This attack on freedom might be easier to get rid of IF enough people demanded the option of NO COMMPUTERS in cars. I prefer to be in complete control of my steering, brakes, and speed. this seems like it is a Democrap induced problem. If they had continued using gas and coal to generate electricity there would be no problem. The Democraps’ green energy (translates to low quality) doesn’t produce enough electricity to replace what the idiots threw away.
In CA residential electric bills will have 12 to 15% added to every bill to pay for all the building of electric producing equipment for the AI companies that will be making $ $$Billions in profits. with the electricity that residents are being forced to supply for them. When a builder builds a tract of houses he has to pay for the hook up to utility co. That cost is added to the cost of every home.
I don’t think that residents should have to foot the bill for AI companies. Unless those companies give each of us 12 to 15% of their profits.
In Michigan, they’re constantly badgering us to switch. Energy costs have, of course, skyrocketed as the traitor Obama guaranteed they would, but this power grab is worse.

Maybe you should have considered the full concept of “Free Speech”. The Government should not limit, control or determine what is or isn’t Free Speech. You most definitely have the right to Free Speech. What you evidently don’t comprehend is there are consequences for exercising your Free Speech when it doesn’t comply with or violates Company Policies. They have every right to terminate you. The most important thing about having Constitutional Freedoms is the Inherent Personal Responsibility that goes with them. When all is said and done, you “F’d” around and Found out. Was it worth it?
