Dear Representative Miller and Suozzi,
On behalf of AMAC Action, the advocacy affiliate of the Association of Mature American Citizens (AMAC), with over 2 million members nationwide, I write in support of H.R. 9500, the Tax Relief for Fraud Victims Act.
Financial fraud is a growing threat to Americans, particularly older adults who are disproportionately targeted by sophisticated scams, investment fraud, identity theft, and other financial crimes. Many seniors spend a lifetime building their savings, only to see those hard-earned assets stolen through schemes that often take months or even years to uncover.
Victims of fraud often suffer devastating financial losses through no fault of their own. Unfortunately, current tax law can prevent these individuals from claiming a theft loss deduction, particularly when this fraud is not discovered until after the statute of limitations for claiming a refund has expired.
Your legislation provides a solution by restoring the pre-2018 theft loss deduction rules and allowing taxpayers to file an amended return for the year in which the related income was reported, even if fraud is discovered after the normal refund deadline. This ensures that victims are not unfairly penalized simply because sophisticated fraud schemes often take years to uncover.
AMAC Action appreciates the bipartisan efforts for this important legislation. Taxpayers who have been victimized by fraud deserve a fair opportunity to recover a portion of their losses. This legislation offers meaningful relief to seniors and all Americans while helping restore confidence in the fairness of our tax system.
