The Supreme Court ruled Monday in favor of allowing President Donald Trump to use the Alien Enemies Act of 1798 to deport five alleged members of the violent transnational gang Tren de Aragua. Democrats and liberal illegal alien advocacy groups had sought to keep the criminals in the United States.
The 5-4 ruling, in which Judge Amy Coney Barrett sided with the Court’s three liberals in dissent, throws out a decision by U.S. District Judge James Boasberg, who previously ordered that the administration could not use the Alien Enemies Act to deport gang members for 14 days.
Boasberg was nominated to the United States District Court for the District of Columbia in 2011 by Barack Obama. He ruled on March 15 that the Trump administration could not deport the alleged gang members as the deportation flights were already in the air – apparently requesting that the flights turn around and come back to the United States.
Boasberg openly considered holding Trump administration officials in contempt for “violating” his orders and allowing the flights to continue. The U.S. Circuit Court of Appeals for the D.C. Circuit then upheld his ruling in a 2-1 decision. The Supreme Court lifted his stay Monday evening.
“Tonight’s decision is a landmark victory for the rule of law,” Attorney General Pam Bondi posted on X. “An activist judge in Washington, DC does not have the jurisdiction to seize control of President Trump’s authority to conduct foreign policy and keep the American people safe. The Department of Justice will continue fighting in court to make America safe again.”
Deputy White House Chief of Staff Stephen Miller also praised the Supreme Court and explained that this decision now allows Trump to fully enforce the law.
“This was a huge – I mean a monumental victory for President Trump,” Miller said. “The biggest legal win of this administration so far. A total embarrassment for crazy Judge Boasberg who’s been trying to force this president to bring foreign alien terrorists back onto American soil, trying to turn our planes around, trying to empty prisons in foreign countries and bring them back to our soil.”
While the Supreme Court did rule in the Trump administration’s favor, the court’s opinion stated that detainees “are entitled to notice and an opportunity to challenge their removal.” However, the Supreme Court added that the alleged gang members would have needed to have brought their case to a court in Texas where they were held, rather than in Washington, D.C.
Trump celebrated the decision in a post on Truth Social. “The Supreme Court has upheld the Rule of Law in our Nation by allowing a President, whoever that may be, to be able to secure our Borders, and protect our families and our Country, itself. A GREAT DAY FOR JUSTICE IN AMERICA!” he said.

Justice Barrett is a coward. She is a mom first and foremost and she is afraid of the street communist and their propensity for violence when they don’t get their way and what they may do to her and her family.
The Supreme Court redeemed their credibility to many who are already disappointed with their leftist Judges. This is actually saving the Democrat Judge from lawsuits if more people are raped or murdered by these illegals.
