Yes, the 14th Amendment of the U.S. Constitutions states: “All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the States wherein they reside.” However, the most pivotal clause in that sentence (“…and subject to the jurisdiction thereof…”) is the crux of President Trump’s executive order to end “birthright citizenship.”

“Subject to the jurisdiction of the U.S.” means owing your political allegiance to the U.S., and not to another country. Children born to aliens are citizens of their parents’ native land, and thus owe their allegiance to, and are subject to the jurisdiction of, that native land.  

Before the adoption of the Fourteenth Amendment in 1868, the Supreme Court issued an opinion in 1857 to overturn the Dred Scott v. Sanford decision, which had held that no black of African descent (even a freed black) could be a citizen of the United States. The Fourteenth Amendment was thus necessary to overturn Dred Scott and to settle the question of the citizenship of the newly freed slaves, and/or citizenship based exclusively on race.

In 2023 it was reported that approximately 7% of all births that year were children born to illegal aliens. The Marxist Left is no longer hiding their border invasion game plan to increase their voter base via illegals, but their plan is on shaky ground. Thank God that President Trump signed the executive order regarding Election Integrity. Yet, that is only the first step – Congress must codify it into law, and state legislatures must do the same for state and local elections.

The illegal border invasion has finally been hugely curbed. Ending birthright citizenship can also squelch the so-called “birth tourism” for those coming to America on valid tourist visas simply to give birth on American soil.

President Trump is not striving to make a new law, but as the Chief Executive of the United States, he has the duty to ensuring the government enforce the correct view of an existing law (14th Amendment et al.) American citizenship is a priceless privilege, which should not be perverted.

Just look at what has happened to Europe! Countries are loosing their identities because vast numbers of migrants have moved in and refuse to adapt to that country’s beliefs and ideologies. The United States is a country founded upon Christianity and its teachings period. Not Muslim, not Hinduism etc. if we don’t protect what we are, we will cease to exist as a nation.

I’m proud to be married to an immigrant whose family came to America to escape communism.
She’s a naturalized citizen, and if anything is more of a hard-liner on illegal immigration than I am.
I think it’s great that people want ro come here and be productive citizens.
But not to be citizens by reproduction.

Game. The. System. That’s what the illegal aliens have done. Every criminal does it. Look for the, so called, loop hole to exploit and use it to maximum advantage. Heck, legal citizens of the US use this technique to “game” the welfare system, social security system, etc. to gain an advantage, i.e. get money they are not entitled to. Watch the activists that pretend to be “judges” to assist the criminal aliens in this matter. I have zero respect for most of our courts judges. I think the referees, umpires, et al, on our nations ball fields have more integrity than do most court judges. Some hack in a black robe – give me a break! There’s my rant for this matter.

The Constitution is very clear. Birthright citizenship is available ONLY to a child born to a parent(s) subject to the jurisdiction of the United States. Giving citizenship to children of tourist or illegals is unconstitutional.

If you accept the intent of birthright citizenship at face value (which I do not) it is an outdated idea and no longer needed or desirable. It was written at a time when the US was in its infancy, expanding across the continent, and desperately NEEDED immigrants. That is not the case today. Today we need targeted, lawful immigration policies.

It is really a combination of the first and second choices. Plus, if you read the comments of those who discussed this Amendment you would see that it was never intended for citizenship to be for everyone born in the US. One it was to reinforce that former slaves and their children were to be considered citizens. A second point was that it would not apply to those who had allegiance to a different nation in any way. Many of our elected officials need to go back and study the notes and discussions of our nation’s Founders so they will better understand the Constitution and the Amendments thereto.

If your parents were foreign diplomats when thier children were born in America they are citizens of the country they represent.

Yes but with a caveat. Birthright citizenship is intended for immigrants, not illegal entry aliens that jump across the border just in time to drop their baby on U.S. soil.

I drive around a beautiful American city and constantly see illegals walking with 5+ kids (mostly looking 9 months each apart) and another pregnant illegal.

There is a common law principle that wrongdoers should not profit or benefit from their wrongdoing. Illegal immigrants are profiting/benefiting from their wrong doing. So illegal immigrants should not be permitted to benefit from birth right citizenship or in any other way. Right now illegal immigrants are being treated better than American citizens and they are burdening our schools and our hospitals, killing and injuring our citizens in all kinds of ways, degrading our society, and spreading horrible diseases. They have no allegiance to our country and therefore are a threat to our national security.

Good men don’t need laws. Evil men won’t obey them, and will always find a way around them.
The “Dem” party has simply become a coalescence of evil — birds of a feather flocking together; lawless people, who will always find ways around the law.
If they can’t can’t change the law, they will change the meaning of words – re-label – in order to pervert the INTENT of the law. But they’d really like to get rid of laws altogether.

Those that come across the border illegally & have a baby, that baby should not have citizenship as the parents have no rights to be here. If someone emigrates to the US legally, with intent to assimilate, make this their home, abide by our laws, but are not yet a citizen & have a baby – yes, that child should be given citizenship. It’s not black or white. Come in illegally, no citizenship for your babies.

Many of the illegal aliens coming to this country came only to drop a kid because they thought if the kid was a citizen, then they could also get benefits. Both parents should be citizens in order for the child to automatically get citizenship.

While the 14th Amendment is clear, our founding fathers were so wise to include a process whereby our Constitution could be amended. The 14th Amendment, when studied in context, was added to protect children of slaves who were born on American soil, and not what is being so abused by illegals today. We have a legal immigration process; let them follow that.

Mist Carter is exactly right. The practice was started during the Johnson administration, by the State Dept. Independently. No legislation, no executive order, no public review of the 14th amendment. A question to ask is why aren’t the children born to diplomats from other countries and tourists included? Also, when the 14th amendment was ratified, it did not include Native Americans, because they were considered to fall under the jurisdiction of their tribes. This was changed, with litigation a few years later.

Birthright citizenship should be reserved for US-born and naturalized American citizens. Any others can be offered the opportunity to seek citizenship guided by a specific process requiring approval similar to the naturalization process.

If I were to travel to another country and give birth, I would not now then be able to say my child is a citizen of that country. Birthright citizenship is a ruse.
