Why NYC Tragedy Means We Need Gun Rights, Not Gun Control

At the end of July, tragedy struck New York City when a deeply troubled Nevada man drove across the country to a Park Avenue office building and opened fire, killing four people before taking his own life. Police believe the gunman intended to target the National Football League, which is headquartered in the building and which the gunman blamed for the debilitating effects of concussions he sustained while playing high school football.  

Unsurprisingly, state and local officials—including New York Gov. Kathy Hochul—immediately sought to lay responsibility for the shooting at the feet of Second Amendment advocates and the allegedly “lax” gun laws of other states. Their blame is grossly misplaced.

Nothing about the shooting demonstrates that the rest of the nation needs New York’s unconstitutionally restrictive gun laws. Instead, it shows precisely how those restrictive gun laws punish ordinary New Yorkers by forcing them to cede their right to armed self-defense—leaving them in difficult positions when the government and corporate security measures fail to keep them safe.

Almost every major study—including the most recent report on the subject by the Centers for Disease Control and Prevention—has found that Americans use their firearms in self-defense between 500,000 and 3 million times annually. In 2021, a professor at the Georgetown McDonough School of Business conducted the most comprehensive study ever on the issue and concluded that roughly 1.6 million defensive gun uses occur in the U.S. every year.

For this reason, The Daily Signal publishes a monthly article highlighting some of the previous month’s many news stories on defensive gun use that you may have missed—or that might not have made it to the national spotlight in the first place. (Read accounts from past months and years here.)

The examples below represent only a small portion of the news stories on defensive gun use during crimes that we found in July. You can explore more using The Heritage Foundation’s interactive Defensive Gun Use Database.

  • July 2, Richmond, Virginia: Police say that a sedan sideswiped a couple’s pickup truck as they drove with their 9-month-old child in the back seat. When the sedan’s driver didn’t initially stop, the couple followed the car for a while, hoping the driver would eventually pull over to exchange insurance information. Instead, the sedan driver led them through a residential neighborhood to a secluded back alley, where an armed woman pointed a gun at the couple and then passed the gun to the sedan driver, who opened fire. The man driving the truck returned fire to defend himself and his family. At the same time, his unarmed girlfriend heroically hurled herself into the backseat to protect the child. The sedan driver was struck in the leg by gunfire, but neither the couple nor their child were injured.  
  • July 5, Jacksonville, Florida: Three masked robbers entered a pawn shop, smashed a display glass case with a hammer, and grabbed nearly $9,000 in jewelry before an armed customer intervened by drawing his concealed handgun and yelling at the robbers to leave the store. One of the robbers raised his hammer and advanced toward the customer, prompting the customer to shoot him once “in the gut.” The robbers ran out of the store, only to be confronted by a different armed witness who fired at them a second time.
  • July 6, Redmond, Washington: Employees of a local business saw a man trying to steal one of their cars, which was parked nearby. When the car’s owner confronted the would-be thief, the suspect “became aggressive” and “advanced” on him, prompting the car owner—who police say was legally armed—to shoot the man in self-defense.
  • July 9, Kansas City, Missouri: A married couple arrived at an apartment complex after arranging over Facebook Marketplace to purchase a truck from two brothers. However, the sale quickly devolved into an armed robbery when one brother tried to take the husband’s cash at gunpoint and the other threatened him with a knife. As the husband tried to leave, the gun-wielding robber shot at him, hitting him in the ear and arm. The victim’s wife, who witnessed the attack from her vehicle, drew her own gun and returned fire at the robbers, striking one and causing them both to flee. She later helped identify both suspects, who were arrested and charged with a slew of felonies.
  • July 10, Sharon, South Carolina: A legally armed driver fatally shot another man outside of a rural Dollar General store, after the man, who police say was also carrying a gun during the incident, “aggressively” approached the driver’s vehicle, threatened him, and punched him. Local officials determined that they won’t file criminal charges, saying his actions constituted lawful self-defense.
  • July 13, Grand Prairie, Texas: A woman’s ex-boyfriend forced his way into her home and assaulted her, inflicting significant injuries. Fortunately, she was able to grab a handgun and fatally shoot her attacker. She was hospitalized for the injuries sustained during the assault but is expected to recover.
  • July 17, Encino, California: In a neighborhood suffering from a spate of recent high-profile violent burglaries, a homeowner awoke in the early hours of the morning to the sounds of something breaking downstairs. He secured his family in a safe room before arming himself with a handgun and shouting a warning to anyone inside the house. The homeowner then saw a dark-clad intruder advance up the stairs, wielding a crowbar, so he shot at the intruder twice. The intruder fled. Later, police arrested a 14-year-old suspect whose mother reported that he’d been wounded in a drive-by shooting, but whose story didn’t hold up to scrutiny. His blood-splattered stolen car matched the description of the intruder’s getaway vehicle.
  • July 18, Sunnyvale, California: Just 24 hours after a jewelry store owner in Anaheim used his firearm to thwart a 20-person “store takeover” heist, a group of approximately 10 serial jewelry store robbers also met armed resistance when they tried to “follow the same playbook” of other mob-style robberies in the area. The robbers rammed a stolen car through the storefront but quickly found themselves confronted by legally armed employees, who sent them fleeing without firing a single shot. Several days later, law enforcement officers arrested five suspects after a similar takeover-robbery attempt at a different store.
  • July 24, Spring, Texas: A homeowner shot and wounded a machete-wielding man who tried to enter his house. Police determined that the homeowner’s actions were justified and charged the would-be intruder with aggravated assault and retaliation.
  • July 26, Traverse City, Michigan: For reasons that remain unclear, a man with a lengthy criminal past and a history of mental illness went on a stabbing rampage inside a Walmart, stabbing 11 people before bystanders heroically intervened to end the attack. Police say that one unarmed victim rammed the attacker with a shopping cart and another victim with a concealed carry permit drew his gun on the knife-wielding man. Eventually, the bystanders were able to successfully detain the attacker and hold him at gunpoint until police arrived on the scene. Fortunately, all 11 stabbing victims are expected to survive their injuries.
  • July 30, Shreveport, Louisiana: When a gunman in illegal possession of a firearm opened fire on another man’s residence, the victim returned fire in self-defense, police say. Despite being hit by a gunshot himself, the armed victim was able to strike and injure the assailant. The assailant—who had a prior felony domestic violence conviction—was arrested and charged with attempted second-degree murder and a weapons offense.

As these examples illustrate, when faced with threats of criminal violence, ordinary civilians are far better off when they have ready access to an armed defense than when they’re forced to rely solely on the government’s intervention.

Instead of blaming Nevada for not implementing laws that wouldn’t have made a difference, New York should look at its own restrictive policies, which frequently prevent ordinary people from exercising their right to keep and bear arms precisely when it matters the most.

Too many people have a simple and basic misunderstanding about “gun control.” “Gun control” is not now, and has never been, about crime, criminals, or public safety. Quite frankly, the Left couldn’t give a rat’s behind about crime, criminals, or public safety. Gun control is, and has always been, about disarming the citizenry so they cannot represent a threat to the government once the Left establishes the dictatorship they have been working toward since the end of World War 2. The key word in the term “gun control” is not “gun” – it is “control.” 

A quick study of basic world history will show that one of the first actions taken by every Communist government upon their takeover was to go to all of the local police stations, get the lists of gun owners, and then go door to door and disarm everyone. That is why the Communists – er, I mean the Democrats – want a national gun registry. Is there really anyone at this point in time who still does not understand this?

By the way, it is way beyond disingenuous that the Left always speaks of “we need gun control” as if there were currently no laws concerning firearms. There are now more than 24,000 gun control laws in effect at the federal, state, and local levels in this nation. Every conceivable aspect of firearm purchase, ownership, and use is covered dozens of times over. Firearms are by far the single most regulated and restricted consumer product in this nation. The only ones who are impacted by all these laws, however, are the law-abiding, which of course is the goal. Criminals very rarely (check the FBI data on this) even attempt to obtain firearms through legal channels, and are thus unaffected by “gun control.” As I stated above, “gun control” has nothing to do with crime or criminals.

And finally, for more than 40 years now, I have been asking a very simple question: Where, in the wording of The Second Amendment, is there any provision for, or even the suggestion of, restrictions, limitations, or exceptions? Answer: There is none. What that means is that every one of those more than 24,000 gun control laws currently on the books is unconstitutional, Court decisions to the contrary notwithstanding.

Praise for you writing this information Amy Swearer – it is important to know that there are American citizens who have common sense and defend themselves from the criminal element .Those of us who have faith in God, practice the qualities that make for good character, have a sense of purpose and live by a code of conduct have a right to self defense. The Declaration of Independence had much to do with the colonists standing up for principles and among those principles there is the idea of people being able to defend themselves. Law and order needs to be maintained to keep society functioning properly. The examples in this article of ordinary citizens coming under attack at times when police were not present and doing what normal, intelligent people do under those circumstances is a matter that is appreciated. .

All these examples show that defunding the police is not working. Crime increases and ordinary citizens have to protect themselves and guns is the best deterrent when encountering these criminals who rear end you and then steal your car or in some cases you follow these criminals who lead you to a secluded place to kill you and steal your car. No social worker can help you. When you call 911 no police officer will come and help you. You have to do that yourself. The politicians all have security details around them live in gated communities but we citizens don’t have that luxury. The democrats are making America into a lawless country. We see it in DC instead of concentrating on stopping crime in DC they call it it DC has been federalized. The President has a legal right to do so because the mayor and city counsel with the police chief made the city a cesspool of crime, homelessness and drug use. The mayor says no need for president Trump to intervene. They are okay with 170 murders down 10 from a year ago. Really 1 death is too many. Not in the eyes of the democrats. That is how life is when you live in a country that allows lawlessness in the name of DEI. We have become a third world country where bands and gangs control the inner cities. Sodom and Gomorrah have been created with pushing trans into society into women’s sport and taking the young kids away from the parents. When that got under their control it was only a short while till they controlled the inner cities. They spend billions on homelessness but it only increased. Where did that money go. What this article proves WE NEED GUN RIGHTS NOT GUN CONTROL.

The constitution encourages citizens to be able to arm themselves to protect both themselves and our nation from threats to our country, both foreign and domestic. It’s that reference to threats on the domestic side that has the progressive/socialist group so worried. That’s their territory. While they’ve caused enormous amounts of erosion into the workings of our constitution, the 2nd amendment still stands in their way of accomplishing a takeover using brute force. Obama once remarked that he and his party could have done so much more if that darned constitution didn’t exist.

Publish all the examples chosen to demonstrate the sensibility of private citizens being armed, as per the Constitution’s Second Amendment. Doesn’t matter. Those who intend to disarm and neutralize all possible opposition to their intentions to acquire and maintain control of all aspects of society pay no attention to reason. They are members of one of the greatest threats to the continuance of the unique American experiment in operative democracy fashioning and running a republicly sovereign nation.

I have been in Texas Law Enforcement all my adult life. On the streets working patrol. Never went inside because I love working with people. I live where I worked. My first Law enforcement job was a Northeast Texas Sheriff Office. Second a suburb to a major Texas City. I learned in Sheriff work that gun laws are for bad folks, not honest everyday folks. Back then we had no permit to carry. You just did nothing to someone who had a gun unless they were doing something stupid, unlawful or was a bad person. Let folks defend themselves because when seconds count, we were minutes away. Why do you think they hit schools and other GUN FREE zones. Because you can’t defend yourself now days. Cowards love victims that can’t defend themselves, because they are cowards. Most street cops understand this. The upper management that cares more about their politics and their job in high places forget where they came from. I am retired now and thank goodness I can carry nationwide. Thanks to people that understand this. After 9-11 Federal law and state laws were passed that retired 25+ years Officer can carry nationwide as long as they qualify with the department every year. Bad folks and politicians love unarmed people so they can do what they want.

We don’t “need gun rights”. What we need is to have our second amendment, right to keep and bear arms, be treated the same as our other rights. Like freedom of speech, freedom of assemble, trial by jury, to be secure in our homes from search, etc.

While this article cites nearly a dozen (in a month) uses of firearm for the protection of citizens, let us not forget that, in many more instances, the display alone – when warranted – of a firearm can and does often dissuade a miscreant to find religion or at least an easier target (pardon the pun).

When you have ever been confronted by an armed criminal you would wish you had a gun. When you are so scared to go out who is then running your city. The 2nd Amendment clearly states: “the right of the PEOPLE to keep and bear arms, SHALL NOT be infringed”; THIS is the right being ADDRESSED ONLY, not ANY elements concerning the infringement thereto: every action taken to affect the right of the People to have at all times and places any way they choose to carry arms, IS “infringement” and Unconstitutional, PERIOD. When and IF, a person exercising that “unbounded” right abuses that right and the associated privileges and immunities thereto AFTER-THE-FACT (including NO infringement), then the other Amendments addressing that infraction come into play: 4th, 5th, 6th, 8th Amendments NOT BEFORE. Then, and ONLY then, can a person’s right to keep and bear arms be modified AFTER an individual trial and conviction on the AFTER-THE-FACT infraction under those OTHER Amendments, PERIOD!!! The actual CRIME addressed in the 2nd Amendment is the INFRINGEMENT barred in its text, PLAIN AND SIMPLE, ENGLISH!!!

I’ve personally used a lawfully concealed licensed pistol numerous times pursuing more than 30 years of self employment in a cash ‘n carry business in the Bronx. Every incident was a succssful deflection of an attempted robbery and or vehicle hijack. The only one I filed a compliant about was disrespectfully dismissd by the Detectives. Reporting risks potential of the NYPD Licensing Division auditing the file to look for an excuse to revoke credntials, conficaste legally posssed firerms, and potentially prosecute the licensee, so unless shots are fired and no one is hurt and the perpetrators flee empty handed, its best to forget about it. The mentlity of New York City and State firarms statute is that the guns thmselves are evil talismans and legitimate self defense is reprhensible. Good citizens and nice folks call the police and wait for them. The foundation of contemporary gun law, the Sullivan Act of 1911, was concocted by a Big City Party Machine Boss to disarm and suppress minorities, especially the dark complexioned Africans, Hispanics, native American Indians, and Italians. The inebrietated Irish were just as undesirable. Nowadays the process of built in delays can take as long as 4 years to get a NYC handgun license and a year for a State permit issued by a County. That’s to keep us safe. The ‘connected’ and affluent can get it faster. Well meaning logical persuasive arguments like this article has nothing to do with the reality.

Just look at the source!!! You’ve got a NAVY BLUE state and city with a female DUM-O-CRAT mayor who will do anything to make sure the party gets enough votes to stay in power. Including being a hideout for illegal immigrants, defying Federal law and ICE, spending millions in gov’t grant money to put illegals up in fancy hotels and rent them cars. What else would expect ? Looks like this may have been another example of HIPPA allowing this to happen! There were reports of this man having mental issues which should have been reported and would stopped him from buying his weapon. Seems like when these are checked out that this seems to be the norm for the “protection” of someone’s health records being made public! Why have these laws in they are not enforced?

You have a few good examples, but did not address the causes of +250 mass shootings in USA so far in year 2025. And I do not have a solution to problem either.
