Draining the Swamp: Supreme Court Ends “Chevron Deference”

July 4th naturally occasions an uptick in reading the Declaration of Independence, whose recitation of transgressions by the king includes the following: “He has erected a Multitude of new Offices, and sent hither Swarms of Officers to harass our People, and eat out their Substance.”  

What we now derisively label the “Swamp,” the “Deep State” or some other damning term, bureaucratic overreach and harassment ranked high among the Founding Fathers’ reasons for breaking from Great Britain after nearly two centuries.  

In the two centuries since, however, administrative state overreach of that same sort has steadily increased under our own government.  

Indeed, growth of the bureaucratic leviathan offers perhaps the most defining characteristic of American governance over the past century. Ever-enlarging administrative agencies staffed by overzealous and overpaid technocrats who pay no price for whatever policy errors they commit, and who remain effectively immune from termination, impose their institutional agendas with near impunity. Mere acronyms such as IRS, EPA, FCC, FTC and ATF strike fear into everyday Americans, who sometimes find themselves subjected to criminal prosecution for regulatory transgressions that they didn’t even know existed.  

That fearsome dynamic accelerated following the 1984 United States Supreme Court decision of Chevron v. Natural Resources Defense Council. That ruling created the notorious “Chevron Deference” doctrine requiring widespread deference to federal agency interpretations of laws those same agencies administer, even if courts interpreted those underlying laws quite differently.  

It’s therefore poetically just that in the days leading up to July 4 this year, the Supreme Court issued a highly anticipated ruling in Loper Bright Enterprises v. Raimondo that overrules the Chevron decision and corrects a four-decade mistake that encouraged the same sort of bureaucratic abuse that led the Founders to declare independence in the first place.  

For two centuries prior to Chevron, the judicial branch interpreted the meaning of laws without inherently favoring either side. Under our Constitution, Congress was empowered to pass laws, presidents and their executive agencies were empowered to enforce them and courts were empowered to interpret them.  

Beginning in the mid-1980s following Chevron, however, courts embarked upon a radically different approach by deferring to however executive agency personnel interpreted federal statutes. That not only upended our constitutional separation of powers as devised by the Founders, it amplified the power of executive branch bureaucrats to enforce laws according to their ideological aims. As Justice Neil Gorsuch emphasized in his concurring opinion, Chevron Deference required courts to “place a finger on the scales of justice in favor of the most powerful litigants, the federal government.” In his words, Chevron meant that, “The reasonable bureaucrat always wins.”  

“Along the way,” Gorsuch added, “Chevron Deference guarantees systemic bias in favor of whichever political party holds the levers of executive power.”  

To illustrate that defect in Chevron Deference, Justice Gorsuch highlighted “Net Neutrality,” the disastrous far-left crusade by the Obama and now Biden administrations to declare internet service a “public utility” subject to broad federal control:   

How bad is the problem? Take just one example. Brand X concerned a law regulating broadband internet services. There, the Court upheld an agency rule adopted by the administration of George W. Bush because it was premised on a “reasonable” interpretation of the statute. Later, President Barack Obama’s administration rescinded the rule and replaced it with another. Later still, during President Donald J. Trump’s administration, officials replaced that rule with a different one, all before President Joseph R. Biden, Jr.’s administration declared its intention to reverse course for yet a fourth time. Each time, the government claimed its new rule was just as “reasonable” as the last.  

With its Loper decision, the Court finally put an end to Chevron Deference. The majority noted that courts prior to the mid-1980s were perfectly able to “make their way intelligently through technical statutory disputes.” Accordingly, again quoting Justice Gorsuch who captured it best, all that changes is that courts will resume doing what they did since the founding until Chevron arrived in the mid-1980s, “resolve cases and controversies without any systemic bias in the government’s favor.”  

For two centuries, even through the hyper-regulatory New Deal, courts did not robotically defer to executive branch agencies on questions of law in that way. Sky-is-falling jeremiads from leftists who desire an overactive bureaucratic state should therefore be dismissed out of hand.  

Moreover, the Court’s ruling is already paying off. Last week, just days after the decision, a federal district court cited Loper in blocking an indefensible attempt by Biden’s Federal Trade Commission (FTC) to impose a nationwide ban on voluntary non-compete agreements.  

The Supreme Court’s decision constitutes an important defeat for the overzealous administrative state, and a vindication of the Founders’ constitutional vision, for which we should again be thankful.

Yes, this was an immensely important decision by the Supreme Court. In essence, it hamstrings the various Executive Branch agencies that had grown accustomed to just making up rules and regulations without any expressed prior authorizing legislation from Congress. It also means that Congress has to go back to writing specific legislation that outlines exactly how the various Executive Branch departments and agencies are to carry out their authorized responsibilities. In short, Congress has to go back to doing their job properly after 50 years of avoiding exactly that. No doubt something that many congressional Democrats and even quite a few old guard establishment GOP types don’t want responsibility for. Which is why Congress changed how they wrote legislation starting in the late 60s and early 70s and why Chevron was the predictable and disastrous logical outcome of embracing an ever more “progressive” (socialist centered) and authoritarian style mindset in the first place. The recent Supreme Court ruling merely restored the proper constitutional setup that the Founding Fathers articulated in the Constitution. Certainly nothing that one should find either radical or out of line with the clear delineation of powers per the Constitution.

Now of course the Democrats have all recently re-launched their various efforts to either pack the Supreme Court with know nothing idiots like the current 3 Democrat appointees on the Supreme Court (Just read their comments on several recent rulings to see their total lack of knowledge regarding either the Constitution or even basic concepts of legal theory.) or try to impeach / remove one or more of the current so-called conservative justices to in their words “even the playing field”, which means return the Supreme Court to the largely left-leaning quagmire it has been since the mid to late 1960s. Democrats merely want the Supreme Court to operate as an automatic rubber stamp of approval for their Marxist agenda. Anything else is unacceptable to them.

Bottom line: We continue to live in a completely bifurcated country. Where half the country wants to retain the aspects of our constitutional representative republic, while the other half wants to usher in a socialist / Marxist authoritarian regime they erroneously believe will be Utopia on earth. Obviously, there is no shared middle ground of values in such a completely incompatible society, so we will continue this tug of war for what the country will be until one side or the other wins.

It’s long past time for unelected, unaccountable bureaucrats to be reined in. Hopefully. the overturning of the Chevron doctrine will be the first step in doing so.

The reference to the Declaration should indicate the ethical standards that are present in a system of systems that had Bureaucracy take on a meaning never intended at the start of the government agency mission. So, time for correction should be appreciated .The term ” over-,zealous administrative state ” is countered properly by the thought of “vindication of the Founders’ Constitutional vision” — Something to be thankful for — Definitely ! Well done Mr. Lee, a right good article putting the Chevron Deference in perspective and providing a history of the matter as you did.

Since the “Greatest Generation” we have raised dependent, submissive, drones willing to defer in all matters to the all powerful “OZ” (The Federal Government) . It’s astounding how quickly things change in this “day and age”.

I’m so thankful for so many good men and women NOW who have taken up the Banner of Freedom, and are INSTANTLY REACTING to what Dems are doing, having been ‘getting away with it’ for now DECADES! but no more! And we, The People, are most GRATEFUL for them, and for being out-spoken so we can be ‘informed’ in this critical time when it’s actually an existential issue now, and it’s a ‘do or die’ situation. When I was a little girl, our Dad made us all learn how to spell ‘antidisestablishmentarianism’ from about 3rd grade! I never knew what it meant, but I could spell it! And only NOW am I realizing how important that word is to understand! I hope you will look it up, because we ALL need to pick up that Banner and Run with it!!! before it is too late. And I feel that’s what President Trump is doing, and THAT is why Dems are so afraid of him! Because he truly wants what is GOOD for America, and Dems simply don’t! They just want to have ‘control’ over all of us! so they can then get all the wealth for themselves! If you don’t believe it – just look around you at how it is NOW after just 4 yrs of Obiden’s world, and compare it to how it was AS SOON AS Trump won in 2016! and for the next 3 years before Dems paid for Covid to ruin our economy! Look at any scale model from `2000 to 2024′, and it’s right there in front of your eyes! Look at the ‘years’ (you remember where you were then), and look at the rates of inflation and our Debt. Find out for yourself! Look at the facts. Then LISTEN to what Dems say, and see how they LIE about Everything! or don’t, and just stay in your little bubble world while everything you love erodes into ‘nothingness’ for you and your children. Wake up! smell the coffee. It’s that simple.

It’s past time Chevron Deference was struck down and law interpretation and making is put back where it belongs. The audacity of 3-letter offices and unelected officials to think they have the right to interpret ambiguity of laws as they see fit. This should have been slapped down long ago and with force unheard of.

Just like abortion back in the 70’s and 80’s, nobody really understood at the time how a corrupt government would abuse those decisions sometime in the future. I know there’s always been abuse but you must admit, it has become exponentially more pervasive over the years. Abortion should have ALWAYS been a state issue, not a federal one! And Chevron took a lot of the accountability away from Congress and through massive abuse, has given us the mess we’re suffering with today! I believe that they’ve gotten to the point where they don’t even care about a “best interpretation” of a law or rule, they just use it to get whatever they want, without any accountability whatsoever!!!

Our founding fathers formed three branches for this Republic, in order that one branch did not control all. Now , it appears that SCOTUS is becoming controlled by political parties when you look at ruling on abortion and now immunity for POTUS. This is not good & SCOTUS needs a Code of Ethics to follow so the justices do not get brainwashed. Lastly, something is wrong with this group when you realize that some decisions have been leaked to certain media prior to final ruling. The person that leaked info needs to be fired & it is time to have term limits for this group.

Great comments PaulE. You mentioned the 60’s. That is when this real mess started. Lyndon Johnson pushed the legislation that had been talked about that would add all theses agencies. The Dems could not get it passed. So, they tricked all of us to get what they wanted. It was time for for a civil rights package, and they knew anything reasonable would get passed, so they piggybacked the agency crap onto the Civil Rights Act. The civil rights part was actually pretty good. But, the Dems took advantage of situation to get what they wanted, knowing it would be very bad for the Republicans to vote no on Civil Rights. What an insult to African Americans. What mess handed to us all. We don’t need the IRS or any of the other agencies added to our government. We added a group the our Military for Space. That was done right. We definitely need to reduce the Federal Government. The only chance we have to do that is with a super majority house and senate serving with President Trump. We need to be way too big too rig.
