Goodbye Affirmative Action, Hello Individual Freedom and Dignity


The Supreme Court just heard arguments in the case Students for Fair Admissions v. Harvard and Students for Fair Admissions v. University of North Carolina.

It’s about affirmative action — universities using race and ethnicity in their admissions policies.

Students for Fair Admissions argues that both universities violate the U.S. Constitution in their discriminatory admissions policies. They discriminate against Asian Americans in favor of Whites, Blacks and Hispanics and unlawfully discriminate to achieve diversity that could be achieved in a race-neutral fashion.

Consensus is that Students for Fair Admissions will win this case and racial discrimination in university admission programs will be gone.

The decision will likely overturn Grutter v. Bollinger, which, in 2003, authorized universities to discriminate as an input factor in pursuit of diversity goals.

This will be a victory for those who see affirmative action as a mistake of the civil rights movement, inconsistent with its goals and the Constitution.

Let’s recall again the words of Dr. Martin Luther King Jr. in his great “I Have a Dream Speech” in 1963. “I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character.”

Next year it will be 60 years since that speech. Would King have thought that more than a half-century after he spoke those words that we would be still so far from that dream?

One reason is the Civil Rights Act of 1964, the crown jewel of the movement King led.

The act went way beyond the goal of making discrimination illegal. It was constructed to use government as the means to achieve a just society.

The Equal Employment Opportunities Commission was created, and the door opened for affirmative action, quotas and the acceptance of the principle that it is lawful to discriminate in favor of certain racial groups to achieve social justice.

Not long after came the categorization of the whole American population into racial groups.

By the 1970s, the entire U.S. population was classified by race and ethnicity through a new racial code called Statistical Directive 15.

We were no longer just Americans. Now every American is formally categorized as White, Black, Hispanic, Asian/Pacific Islander and American Indian/Alaskan Native.

Why? We entered a new era in which it was assumed that government force and action were needed achieve social justice, and toward this end, every citizen needed to be put in a racial or ethnic category.

King might as well have said, “I have dream that one day we will categorize every American according to their race and ethnicity and government will use this as basis to decide who should have what.”

In the oral arguments in the case against Harvard and UNC, Justice Clarence Thomas questioned what diversity means and achieves. “I’ve heard the word diversity quite a few times, and I don’t have a clue what it means. It seems to mean everything for everyone.”

The diversity that really produces benefit in education is diversity of opinion, and Harvard has virtually none. In the most recent annual survey that the Harvard Crimson does of the university faculty of Arts and Science, more than 80% self-identified as “liberal” or “very liberal.” Only 1% self-identified as “conservative” and zero as “very conservative.”

Chief Justice John Roberts got to the heart of the matter when he observed in Parents Involved v. Seattle in 2007, “The way to stop discrimination on the basis of race is to stop discriminating on the basis of race.”

The good news is the Supreme Court seems ready to start turning this around. With the court finding discrimination in college admissions unconstitutional, we’ll be taking a major step to restore individual freedom and dignity and end the demeaning, dehumanizing idea of reducing individuals to racial and ethnic categories.

WTF? I never heard that whites are a preference over Asian Americans! Whites are never listed as a category in affirmative action!

The court should go full Constitution and state that racial quotas ARE racial discrimination and are therefore unconstitutional! Further, they should outlaw the mention of race in any and all kinds of records. Photos in such records are legitimate, but the category, race, should be eliminated!!

Perhaps it would be best to not list sex, race and perhaps names on applications but a generic number of some kind in hopes of not being able
to do anything but admit the most qualified applicants.

I was thinking the same thing. Maybe applications to college or work places should submit resumes or CVs without names and addresses on them, just a number or alpha-numeric identifier. The document details would be the only deciding factor regarding eligibility.

I agree so much it should be wiped out in the academic world as well as in employment. My husband was passed over several times for a promotion. There could have been no other reason than he’s white and male. He has years more seniority and way more working knowledge and helps other people when they ask him. These ladies can’t answer any questions about the work at all. When they do they usually give wrong information which causes errors and sometimes causes accounts to be written off instead of collected, thus costing the company money. One had only been there six months and couldn’t do the job correctly at all. But because of her race and being female she got the job.

Along with affirmative action they need to get rid of the welfare state (War on Poverty) that has cost taxpayers billions of dollars and done more harm than good.

The more hateful Progressives can divide US, the more they have control over US. To be truly free from oppression, we must be united as American citizens first. Ethnic identity is a social issue that we must not let government control.

In the article stating race categories white is written with a small “w”. The rest have captitals. Is this an error? If so please correct. To discuss discrimination and then write “white” small w and then continue next to it “Black” capital b is in itself discrimination.

Unfortunately even as an “American” which infers being a citizen trying to realize the American Dream, it has become questionable as to what benefit that status has other than getting taxed for everyone else’s freebies and handouts or to buy votes.

Affirmative Action is racist, and those who support favored policies for certain people based on skin color, to artificially boost the blacks to a higher socio- economic status, are highly misguided. America is a fair society that encourages hard work and accomplishments. To give rewards to certain groups of people based on their identities encourages favoritism and entitlement. Favoritism and entitlement are significant enemies of our Constitutional Republic.
