AMAC – Court Rules That Obamacare’s Contraception Provision Must be Amended to Protect Religious Freedom

Administration must rewrite the mandate to ensure religious institutions have a right to practice what they preach’ -

BOHEMIA, NY, Dec 21 – “Our members and many others who rallied to protect Religious Freedom this week won a preliminary victory when a federal court told the Obama administration to rewrite the health care law’s contraception mandate,” according to Dan Weber, president of the Association of Mature American Citizens.

The mandate would force religious institutions to pay for certain employee contraception and abortion costs even though it would force them to ignore their established teachings.  “The D.C. Circuit Court of Appeals said in its ruling that the administration must rewrite the mandate to ensure religious institutions have a right to practice what they preach.  It was a victory not just for church-based organizations but for all who believe and want to protect all of the rights guaranteed in our Constitution.”

Weber explained that Wheaton College and The Becket Fund for Religious Liberty were among dozens of church organizations that sued the government over the mandate.  Many non-affiliated organizations, including AMAC, offered direct and indirect support.

“Apparently we made it too hot of an issue for the government and so during oral arguments the Health and Human Services Secretary Kathleen Sebelius relented and promised the mandate would be amended.  But the court wanted more than promises.  It ruled that the administration must rewrite the Obamacare provision by August 2013.  In addition, the court demanded that the government provide progress reports every 60 days in the interim.”

Kyle Duncan, who argued the case for the Becket Fund put it this way: “The D.C. Circuit has now made it clear that government promises and press conferences are not enough to protect religious freedom.  The court is not going to let the government slide by on non-binding promises to fix the problem down the road.”

Weber said that the ruling is an example of how powerful individuals can be when they band together for a common cause.  “In this case, the cause is the protection of the rights guaranteed by the Constitution and the Association of Mature American Citizens is proud to have played a small role in achieving this first win.  We recognize that we have a long way to go before we get a final resolution to this controversial issue.  But, with the support of our members, we will not give in until we have won this fight decisively.”

    I am British born and raised and grew up with Government run healthcare. Believe me, you don’t want it. All my family is still in the UK. Ten years ago my mother was diagnosed with blocked carotid (neck) arteries. She was 73 at the time. I visited the doctor with her as I was back home at the time. He was an Indian doctor, as the majority of them are in England. (Please don’t imagine for one minute that Doc Martin is in any way typical of England’s Health Service). Anyway, Dr. Patel told my Mom in no uncertain terms that basically she was too old at 73 for carotid surgery. Mom lived with being dizzy for four more years and at 77 died of a massive stroke. I tried to intervene but got nowhere. In retrospect, I wish I had brought her to America for surgery. She might be alive today.
    Many people I know are travelling abroad to get needed surgery performed as the waiting list is months. Have any of you seen the movie “The Most Exotic Marigold Hotel”? If so, you will remember that the character played by Maggie Smith was travelling to India for hip replacement surgery as she was in pain and tired of waiting for the NHS.

    How did Obamacare get passed when nobody wanted it? By sneaky means at midnight behind closed doors and bribes if you’ll remember. Hopefully getting the birth control rescinded will just be the start. Wake Up people – This Is Your Life.

      I am Jewish, my Internist found I have blood cloths in my left leg. Without thinking I went to St. Francis Hospital for the treatment. It happen to be the best hospital for heart and vascular problems in New York State. I am 75 years old. I am on medication now and my Internist is monitoring my well being on a weekly bases. It did not bother me that the cross was on the wall in my room in the hospital. After all Jesus was a Jewish Rabbi from Nazareth, and I have often looked up to the Cross while I was in the hospital, needless to say I don’t want Obamacare

        Paul, It is not real Jews like you that are the problem. It is the atheists, who worship money and have Marxist leanings that are the problem. They will stop at nothing until they have all the money and total control. They could not win an election honestly and use the names of people long dead and the welfare crowd to get into office. We should sue for two things– to have the voting rolls purged and to begin again with registration of only those people not dependent for their livelihood on the government. The founding fathers did not give them the right to vote and neither should we allow it.

          Marcella, your points seem to refer to Democrats and the left. Please don’t paint all atheists with the same brush. Just as all Christians and Jews are not ‘good’, all atheists are not ‘bad’. Atheism is simply a non-belief in a divine being. Some seem to be driven by hate and anti-Christianity and I find them as objectionable and vile as you do, but we are not all that way. Their hate mongering messages do not speak for us all! I am a staunch Conservative. I do not believe in abortion. I have no problem with “in God we trust” on our money, or children saying the Lord’s prayer in the morning at school. I sent my daughter to a Christian school and the headmistress was aware of my non-belief, but in spite of it we carved a friendly relationship and I spent many hours volunteering at the school. Our children have been encouraged to find their own path and one of them keeps a bible on her bedside table. That’s called Freedom of Religion.

      Elections do indeed have consequences, and we will all pay for the ignorant that HAVE voted for this man that is slowly making a mess of the Country. The election was partly the fault of the ignorant, and partly the fraudulent voting results that NO ONE has courage to confront.

    It’s interesting that nothing about this has been seen in any news reports on websites such as aol or yahoo. Wonder why? Contradictory to their thinking? One thing I must admit, I think birth control is not a bad idea, especially for obama supporters, although the welfare group will not use it, only the sandra fluke group of sluts, which we don’t want to reproduce anyhow. Abortion is another matter – abortion should by not, by any means, be supported by government funds – or any funds.

      Jean, I don’t believe there’s even been any mention of the religious organizations’ lawsuit against the federal government for violation of their religious freedom in any of the mainstream media outlets. As I see it, that just goes along with their hero worship of the Man-Child in Chief…..Can’t have anything that smacks of criticism of their hero or anything he does, y’know.

      We can bring up the topic on those forums, with links, but dollar to donuts our posts will be deleted. It’s worth a try anyway.

      And…..the strong hand of the government will either force us to pay for abortions, or charge an outrageous fee if we do not comply. A fee so unattainable, that it will force many to close their doors or compromise their principles and pay for abortion.

      Hobby Lobby is one such organization that has been fighting this HHS Mandate in Court. Unfortunately the ruling has come down that they must comply with paying for contraception, abortion inducing drugs, and sterilization. They plan to take their chances and see what kind of a fee they actually get hit with.

      This is TOTALLY UNCONSTITUTIONAL. It is against our first freedom…..freedom of religion. When we loose that, we will eventually LOOSE EVERYTHING.

    The comment by Joana is all true. I just retired after more than 23 years in Medical Billing and Insurance. But this Bill involves more then Health Care if anybody wants to take a close look at it. The whole thing needs to be done away with. A health care bill should be done in an honest and forth right way for the good of all the people and be just about Health Care. It should not have every tax they can think of or any way they can get more of a percentage of what income we have left.underhandedly put in it. If what they call the rich are discouraged to stay in the USA and upgrade their businesses, increase their productivity and therefore produce more jobs, then we all might as well forget it. The suppose to be middle class can not spend what they use to without losing everything. They in turn become poor and the amount of the poor just grows and grows and grows. With not enough increase in jobs there is less people able to pay taxes, less people able to spend as they use to and holding on tighter to what they do have because no one can count on having their job they do have when tomorrow comes. The longer this goes on the worse this gets. It just multiplies. We are ready to go over “a ‘financial’ cliff” ! Does not anyone know what this means? If this does not change immediately we are all going to be considered “poor” for our Country will be without money, therefore “WE”, the “People”, will be without money. All of us! Our Country will not be able to borrow money. It is just like family finances going downhill. The difference is this is a Country’s finances so this involves “ALL OF US”! I pray that everyone will come to their senses and search their hearts and do what is right. May God bless America and May she SURVIVE!

      ObamaCare wasn’t a healthcare bill. That was merely the pretext for the government to enact a whole host of new taxes, take over the entire healthcare industry, massively increase federal government oversight into anything even remotely associated with healthcare and finally serve as phase one of a plan to move us towards the same universal healthcare horror show enjoyed by our European friends. The one where you get to wait weeks or months to see a doctor and then the doctor has to follow the guidelines for treatment laid out by the government.

      ObamaCare isn’t supposed to work. It’s supposed to cause so much pain and anguish, that the people demand the government fix it. That is when phase two kicks in. The fix the government will impose will be European style universal healthcare with all the problems that system has.

      You are correct in your analysis of where this class warfare, politics of envy will lead us. Just turn on the nightly news and watch the images from virtually any southern European country. Greece, France, Spain, it doesn’t really matter. It’s all the same. Periodic riots, persistently high unemployment, food shortages, high taxes on everything, little to no private sector economy left standing, massive government regulations in all areas of the economy making it impractical for anyone to run a small business with more than 10 or 20 employees. That’s the utopia that Obama and the Democrats are leading us towards. That sadly is the utopian vision the idiots who voted to re-elect Obama and retain Democrat control of the Senate ensured we will get.

      We’re already over it. Bill Clinton, for all of his faults, did leave the nation headed in the direction of balanced budgets and financial stability. He was better about controlling the invasion of the US than George I or Obama. It’s these past twelve years that have brought the US to a point that seems beyond redemption, ethically, economically, or as a free, constitutional nation.

      Why is no one in DC saying no more government expenditures for non-citizens? Where’s the outrage that the “Dream Act” gives jobs to non-citizens, while the feckless hypocrites in DC “have to extend unemployment benefits” (hint: give them the jobs that non-citizens are filling). Why are we still draining our economy fighting and encouraging wars to annihilate global civilization? Why when “cave-man” Boehner sold us out and increased the debt limit did no one express outrage that the first thing Obama did was offer free birth control for all? When is this near-0% interest on CD savings going to end….it’s financially destroying Seniors and creating a situation where the next generation can never prepare for retirement. WHERE IS THE OUTRAGE??

      I really think we’d be better off if everyone’s taxes went up on January 1. If everyone has some “skin in the game”, they’ll change their attitudes about a government that makes drunken sailors look like budgetary geniouses in comparison. What will happen?….people will buy less crap manufacured by slave labor in China.. There might be calls for viable public transportation. People might actually spend money closer to home and help local economies.

      I really don’t think there’s a way out of this mess. Someone posted we should split into two countries. I submit we should split into 50 countries, and send a lot of government responsibility back to local communities.

    Your comments are great and I sense your frustration with them not being printed. My experience with any type of comment section is that you’re limited word wise. Perhaps that is what happened with the delay. Luckily it has now appear a couple of times. I do have a suggestion. You’re a very well informed and excellent writer. If I were you, I’d contact Dan Weber and see about writing some afrticles for AMAC or becoming an Ambassador. I think that you have alot to share with folks.

    This is great, but why wait until August of 2013. It doesn’t take eight months to rewrite a few lines. A good half-day should do it. The lazy overpaid government is allowed too much leeway.     Yes, the Obamacare Contraception Mandate must be repealed as it infringes upon our Religious Freedom and this must never happen. However, the battle should have been addressed and fought from the beginning addressing the demise of the Sanctity of Human Life from Conception until Natural Death under Obamacare.

    However, Obamacare must be entirely RESCINDED/STOPPED/LAID to rest as it encompasses infringing upon the right to life of all Americans from the baby in the womb, to the infant, to children, youth, middle aged, elderly. Obamacare embraces “comparative effectiveness” … diagnosis tests, treatment and medical care only to be given to those they deem worthy of care and life itself … Obamacare/15 member panel in charge of making these decisions…who shall live and who shall die… takes away the, here-to-for, patient/personal physician relationship in which a patient and his/her private physician made medical decisions. Obamacare ruins/sabotagies the individual patient/physician relationship. It encompasses health care rationing, panels that determine who shall live and who shall die.

    The Obama Administration has targeted Seniors, as well as others they deem unworthy of diagnostic tests, medical care and treatment… it has taken billions of dollars out of Medicare to fund the new patients Obamacare is bringing in under Medicaid. You can not rob Peter to pay Paul… the end does not justify the means.

    Obamacare must NOT be allowed to take effect!

    The list goes on as to the Obama Administrations targeting senior citizens. It was in the news a few days ago that the Obama Administration wants to change the way the cost of living increases are made for Social Security recipients, their motive being to prevent seniors from getting increases in their Social Security checks… a pittance of money that helps seniors meet their cost of living to buy food, medicine, live day to day. How callous of the Obama Administration! It is well known that not giving seniors their, here to fore, justified Cost of Living increases will lead to their demise as they will not be able to purchase needed medicine and food and necessities of daily living.

    God have Mercy and Protect the Sanctity of Life of all Americans from Conception until Natural Death. St. Michael, the Archangel defend us!

      Your post does a very good job of articulating some of the inherent hypocrisy and subjective nature of ObamaCare. It is a terrible law and will have devastating consequences for our entire healthcare system as its implementation progresses. Many doctors will simply choose to leave the profession, as the regulatory and expense burdens of ObamaCare consume far too much of both their time and personal finances to justify their continuing to practice medicine. Hospitals will also experience many negative effects of ObamaCare, as the government increasingly dictates which procedures to use and how they are to be performed. Finally, patients will be on the receiving end of a overall lower quality of healthcare, with longer wait times, higher costs and greater mortality rates.

      You have to remember that ObamaCare was not about improving the quality of healthcare or reducing costs to the individual. We already had the best healthcare system in the world, as evidenced by the fact that every time any world leader needed critical care, he or she flew to the United States to receive it. They could have opted to receive care in their own country or flown anywhere else in the world, but they always ended up coming here. Now sadly, we will be moving towards the universal care model, also known as single payer, that has ruined healthcare in much of the industrialized world. ObamaCare is merely the bridge to that eventuality, as it is supposed to fail and cause such public outrage that the people allow government to quickly adopt the single payer model with all its inherent flaws.

      That said, you call for ObamaCare to NOT be allowed to take effect. That option no longer exists. As they say “elections have consequences” and that sadly is a major one, along with all the other ill-conceived laws passed in Obama’s first term. The majority of American voters decided to foolishly re-elect Obama and the Democrats in the Senate. That ended any possibility of a total repeal of ObamaCare before it started to roll out in full force. There simply aren’t the votes to do it. Once ObamaCare implementation starts in full force in early 2013, it will be virtually impossible to ever stop it. No federal entitlement, once implementation has fully started, has ever been repealed or ended going all the way back to the 1930s.

      I share your concerns about what a total train wreck ObamaCare is going to be, but aside from some tweaks around the edges, like this little court ruling, don’t expect any wholesale repeal or major scale backs in implementation. Now we have to ensure that HHS doesn’t try an end run around this court ruling by attacking on another front to accomplish essentially the same thing. Remember, ObamaCare is merely a bridge to the left’s grand utopia of single payer healthcare and total control of all facets of life.

Remember, ObamaCare is merely a bridge to the left’s grand utopia of single payer healthcare and total control of all facets of life. Just try to do the best you can to avoid the need for major medical care.

      Yes, the Obamacare Contraception Mandate must be repealed as it infringes upon our Religious Freedom and this must never happen. However, the battle should have been addressed and fought from the beginning addressing the demise of the Sanctity of Human Life from Conception until Natural Death under Obamacare.

      However, Obamacare must be entirely RESCINDED/STOPPED/LAID to rest as it encompasses infringing upon the right to life of all Americans from the baby in the womb, to the infant, to children, youth, middle aged, elderly. Obamacare embraces “comparative effectiveness” … diagnosis tests, treatment and medical care only to be given to those they deem worthy of care and life itself … Obamacare/15 member panel in charge of making these decisions…who shall live and who shall die… takes away the, here-to-for, patient/personal physician relationship in which a patient and his/her private physician made medical decisions. Obamacare ruins/sabotagies the individual patient/physician relationship. It encompasses health care rationing, panels that determine who shall live and who shall die.

      The Obama Administration has targeted Seniors, as well as others they deem unworthy of diagnostic tests, medical care and treatment… it has taken billions of dollars out of Medicare to fund the new patients Obamacare is bringing in under Medicaid. You can not rob Peter to pay Paul… the end does not justify the means.

      Obamacare must NOT be allowed to take effect!

      The list goes on as to the Obama Administrations targeting senior citizens. It was in the news a few days ago that the Obama Administration wants to change the way the cost of living increases are made for Social Security recipients, their motive being to prevent seniors from getting increases in their Social Security checks… a pittance of money that helps seniors meet their cost of living to buy food, medicine, live day to day. How callous of the Obama Administration! It is well known that not giving seniors their, here to fore, justified Cost of Living increases will lead to their demise as they will not be able to purchase needed medicine and food and necessities of daily living.

      God have Mercy and Protect the Sanctity of Life of all Americans from Conception until Natural Death. St. Michael, the Archangel defend us!
